Enacts Paige's law to provide education and awareness regarding brain arteriovenous malformation and brain aneurysms, as well as information on being a potential carrier of hereditary hemorrhagic telangiectasia, thoracic aortic aneurysms, Marfan syndrome and related disorders and genetic testing for such conditions and disorders.

TITLE OF BILL:

An act to amend the public health law, the education law and the execu-
tive law, in relation to enacting Paige's law

 
PURPOSE:

To set the standards for proper screening and training for the detection
of arteriovenous malformation.

 
SUMMARY:

Section 1: This act shall be known and may be cited as "Paige's law"

Section 2: Adds a new paragraph 1 to section 2500-a of the public health
law

Section 3: adds new section 2500-m to public health law

Section 4:  amends education law by adding new section 3001-e

Section 5: section 206 of public health law is amended by adding a new
subdivision 32

Section 6: public health law is amended by adding new section 3055

Section 7: section 840 of the executive law is amended by adding a new
subdivision 8

Section 8: the executive law is amended by adding a new section 214-i

Section 9: amends education law by adding a new section 926

Section 10: Effective date

 
JUSTIFICATION:

On January 8, 2018, Paige Keely, a bright-eyed energetic, six-year-old
from St. James, passed away as a result of a ruptured AVM (arteriovenous
malformation). Paige went off to school that day not knowing that it
would be the last time her mother would hear her voice. Paige was eating
lunch when she went crying to the lunch aide, she had a really bad head-
ache.

The school nurse called her mother immediately, since Paige was not a
"frequent flyer" at the nurse's office. The nurse told Paige's mother to
come get her. Moments later, she called her back saying they had called
an ambulance - that Paige was unresponsive. Paige vomited and began
seizing and then went unresponsive.

Paige continued to seize the whole ambulance ride and, when they arrived
at the hospital, doctors were working to resuscitate her.  Within a few
short hours, Paige lost her life to an undiagnosed Brain Arteriovenous
Malformation (AVM) like so many who have lost their life or suffered
from this "Silent Beast."

Paige's last words were "I have a really bad headache." The doctors who
worked to save her life said that Paige was born with an AVM, which is
congenital and present from birth. If the doctors knew of the condition,
they would have been likely to operate, and Paige would most likely be
with us today.  Screening and training are so important to prevent what
happened to Paige from happening to another child.

EFFECTIVE DATE:

 AN ACT to amend the public health law, the education law and the  execu-
   tive law, in relation to enacting Paige's law
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Short title. This act shall be known and may  be  cited  as
 "Paige's law".
   §  2.  Subdivision  1  of  section  2500-a of the public health law is
 amended by adding a new paragraph (l) to read as follows:
   (L) HEREDITARY HEMORRHAGIC TELANGIECTASIA AND  THORACIC  AORTIC  ANEU-
 RYSMS  AND  DISSECTIONS  THROUGH  GENE  SEQUENCING,  MARFAN SYNDROME AND
 RELATED DISORDERS.
   § 3. The public health law is amended by adding a new  section  2500-n
 to read as follows:
   § 2500-N. HEREDITARY HEMORRHAGIC TELANGIECTASIA, THORACIC AORTIC ANEU-
 RYSMS,  MARFAN  SYNDROME AND RELATED DISORDERS PRENATAL SCREENING AWARE-
 NESS. 1. AS USED IN THIS SECTION, "HEALTH  CARE  PRACTITIONER"  MEANS  A
 MEDICAL PROFESSIONAL THAT PROVIDES PRENATAL CARE.
   2.  A  HEALTH  CARE  PRACTITIONER  CARING  FOR A PREGNANT PERSON SHALL
 PROVIDE TO SUCH PERSON MATERIALS PROMULGATED BY THE  COMMISSIONER  WHICH
 INCLUDE  INFORMATION  ON  BEING A POTENTIAL CARRIER OF HEREDITARY HEMOR-
 RHAGIC TELANGIECTASIA, THORACIC AORTIC ANEURYSMS,  MARFAN  SYNDROME  AND
 RELATED  DISORDERS AND THE AVAILABILITY AND OPTIONS FOR PRENATAL SCREEN-
 ING FOR SUCH CONDITIONS AND DISORDERS.
   § 4. The education law is amended by adding a new  section  3001-e  to
 read as follows:
   §  3001-E. BRAIN ARTERIOVENOUS MALFORMATION, BRAIN ANEURYSM AND STROKE
 AWARENESS AND RESPONSE TRAINING. 1. (A) TEACHERS SHALL ANNUALLY COMPLETE
 A COURSE OR TRAINING IN THE IDENTIFICATION OF AND RESPONSE  TO  A  PUPIL
 
  EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                       [ ] is old law to be omitted.

 EXPERIENCING  A  BRAIN  ARTERIOVENOUS  MALFORMATION,  BRAIN  ANEURYSM OR
 STROKE.
   (B) DOCUMENTATION SHOWING THE SUCCESSFUL COMPLETION OF THE INSTRUCTION
 REQUIRED  PURSUANT  TO  THIS  SECTION  SHALL  BE  KEPT IN SUCH TEACHER'S
 PERSONNEL FILE.
   2. THE TRAINING REQUIRED PURSUANT TO THIS SECTION MAY BE PERFORMED  BY
 THE REGISTERED NURSE AT THE SCHOOL IN WHICH THE TEACHER IS HIRED TO WORK
 OR BY A RECOGNIZED TRAINING PROGRAM APPROVED BY THE COMMISSIONER THROUGH
 ANY  METHOD AVAILABLE, INCLUDING BUT NOT LIMITED TO COURSES ONLINE OR IN
 PERSON.
   § 5. Section 206 of the public health law is amended by adding  a  new
 subdivision 32 to read as follows:
   32. THE COMMISSIONER, IN CONSULTATION WITH THE MUNICIPAL POLICE TRAIN-
 ING  COUNCIL  AND  THE  SUPERINTENDENT  OF STATE POLICE, SHALL DEVELOP A
 TRAINING PROGRAM AND ASSOCIATED TRAINING MATERIALS TO BE GIVEN ANNUALLY,
 TO PROVIDE INSTRUCTION AND INFORMATION TO POLICE OFFICERS AND  EMERGENCY
 MEDICAL  SERVICES  PERSONNEL  ON PROTOCOLS FOR THE IDENTIFICATION OF AND
 RESPONSE TO AN INDIVIDUAL EXPERIENCING A BRAIN  ARTERIOVENOUS  MALFORMA-
 TION, BRAIN ANEURYSM OR STROKE.
   §  6. The public health law is amended by adding a new section 3055 to
 read as follows:
   § 3055. BRAIN ARTERIOVENOUS MALFORMATION, BRAIN  ANEURYSM  AND  STROKE
 RESPONSE  TRAINING.  THE COMMISSIONER SHALL PROVIDE THE TRAINING PROGRAM
 RELATING TO PROTOCOLS FOR THE IDENTIFICATION OF AND RESPONSE TO AN INDI-
 VIDUAL EXPERIENCING A BRAIN ARTERIOVENOUS MALFORMATION,  BRAIN  ANEURYSM
 OR  STROKE PURSUANT TO SUBDIVISION THIRTY-TWO OF SECTION TWO HUNDRED SIX
 OF THIS CHAPTER TO ALL EMERGENCY MEDICAL SERVICES  PERSONNEL  INCLUDING,
 BUT  NOT  LIMITED  TO,  FIRST RESPONDERS, EMERGENCY MEDICAL TECHNICIANS,
 ADVANCED EMERGENCY MEDICAL TECHNICIANS AND EMERGENCY VEHICLE OPERATORS.
   § 7. Section 840 of the executive law  is  amended  by  adding  a  new
 subdivision 8 to read as follows:
   8. THE COUNCIL SHALL, IN ADDITION:
   (A)  DEVELOP,  MAINTAIN  AND  DISSEMINATE,  IN  CONSULTATION  WITH THE
 COMMISSIONER OF HEALTH, WRITTEN POLICIES AND PROCEDURES CONSISTENT  WITH
 SUBDIVISION  THIRTY-TWO  OF SECTION TWO HUNDRED SIX OF THE PUBLIC HEALTH
 LAW, REGARDING PROTOCOLS FOR THE IDENTIFICATION OF AND  RESPONSE  TO  AN
 INDIVIDUAL  EXPERIENCING A BRAIN ARTERIOVENOUS MALFORMATION, BRAIN ANEU-
 RYSM OR STROKE. SUCH POLICIES AND PROCEDURES SHALL MAKE  PROVISIONS  FOR
 THE  EDUCATION  AND  TRAINING OF NEW AND VETERAN POLICE OFFICERS ON SUCH
 PROTOCOLS; AND
   (B) RECOMMEND TO THE GOVERNOR, RULES AND REGULATIONS WITH  RESPECT  TO
 THE  ESTABLISHMENT  AND  IMPLEMENTATION  ON AN ONGOING ANNUAL BASIS OF A
 TRAINING PROGRAM FOR ALL CURRENT AND NEW POLICE OFFICERS  REGARDING  THE
 POLICIES AND PROCEDURES ESTABLISHED PURSUANT TO THIS SUBDIVISION.
   §  8.  The  executive  law is amended by adding a new section 214-j to
 read as follows:
   § 214-J. BRAIN ARTERIOVENOUS MALFORMATION, BRAIN ANEURYSM  AND  STROKE
 RESPONSE  TRAINING.  THE  SUPERINTENDENT  SHALL,  FOR ALL MEMBERS OF THE
 STATE POLICE:
   1. DEVELOP, MAINTAIN AND DISSEMINATE, IN CONSULTATION WITH THE COMMIS-
 SIONER OF HEALTH, WRITTEN POLICIES AND PROCEDURES CONSISTENT WITH SUBDI-
 VISION THIRTY-TWO OF SECTION TWO HUNDRED SIX OF THE PUBLIC  HEALTH  LAW,
 REGARDING  PROTOCOLS  FOR THE IDENTIFICATION OF AND RESPONSE TO AN INDI-
 VIDUAL EXPERIENCING A BRAIN ARTERIOVENOUS MALFORMATION,  BRAIN  ANEURYSM
 OR  STROKE.  SUCH  POLICIES AND PROCEDURES SHALL MAKE PROVISIONS FOR THE
 EDUCATION AND TRAINING OF NEW AND VETERAN POLICE OFFICERS ON THE  PROTO-

 COLS FOR RESPONSE TO VICTIMS OF SUSPECTED DRUG OVERDOSE AND THE ADMINIS-
 TRATION OF OPIOID ANTAGONISTS; AND
   2.  RECOMMEND  TO  THE GOVERNOR, RULES AND REGULATIONS WITH RESPECT TO
 THE ESTABLISHMENT AND IMPLEMENTATION ON AN ONGOING  ANNUAL  BASIS  OF  A
 TRAINING  PROGRAM  FOR ALL CURRENT AND NEW POLICE OFFICERS REGARDING THE
 POLICIES AND PROCEDURES ESTABLISHED PURSUANT TO THIS SUBDIVISION.
   § 9. The education law is amended by adding a new section 926 to  read
 as follows:
   §  926. BRAIN ARTERIOVENOUS MALFORMATION AND BRAIN ANEURYSM AWARENESS.
 EACH SCHOOL SHALL PROVIDE TO THE  PARENT  OR  GUARDIAN  OF  EVERY  CHILD
 ENTERING  KINDERGARTEN  EDUCATIONAL MATERIALS PROMULGATED BY THE COMMIS-
 SIONER, IN CONSULTATION WITH THE COMMISSIONER OF HEALTH, REGARDING BRAIN
 ARTERIOVENOUS MALFORMATION AND BRAIN ANEURYSMS, AS WELL  AS  INFORMATION
 ON  BEING  A POTENTIAL CARRIER OF HEREDITARY HEMORRHAGIC TELANGIECTASIA,
 THORACIC AORTIC ANEURYSMS, MARFAN SYNDROME AND RELATED DISORDERS AND THE
 AVAILABILITY AND OPTIONS FOR GENETIC TESTING  FOR  SUCH  CONDITIONS  AND
 DISORDERS.
   §  10.  This  act  shall  take effect on the one hundred eightieth day
 after it shall have become a law. Effective immediately,  the  addition,
 amendment  and/or  repeal  of  any  rule or regulation necessary for the
 implementation of this act on its effective date are  authorized  to  be
 made and completed on or before such effective date.
