 Introduced  by  Sens. WEBER, BORRELLO, MATTERA, OBERACKER, O'MARA, ROLI-
   SON, TEDISCO -- read twice and ordered printed, and when printed to be
   committed to the Committee on Veterans, Homeland Security and Military
   Affairs
 
 AN ACT to amend the executive law, in relation to authorizing a  county,
   city, town or village to override a state disaster emergency in all or
   part of the territorial limits of such local government
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 28 of the executive law is amended by adding a  new
 subdivision 6 to read as follows:
   6.  A  COUNTY, CITY, TOWN OR VILLAGE MAY, AT ANY TIME, LIMIT OR SUPER-
 SEDE A GOVERNOR'S DECLARATION OF A DISASTER EMERGENCY BY EXECUTIVE ORDER
 ISSUED UNDER THIS SECTION, BY ISSUING A LOCAL  STATE  OF  EMERGENCY  AND
 LOCAL  EMERGENCY  ORDERS UNDER SECTION TWENTY-FOUR OF THIS ARTICLE.  THE
 LOCAL STATE OF EMERGENCY AND LOCAL EMERGENCY ORDERS  SHALL  ONLY  EFFECT
 PART OR ALL OF THE TERRITORIAL LIMITS OF SUCH LOCAL GOVERNMENT.
   §  2.  Section  29-a  of  the executive law is amended by adding a new

 SEDE    A  GOVERNOR'S  DECLARATION  OF A DISASTER EMERGENCY BY EXECUTIVE
 ORDER ISSUED UNDER THIS SECTION, BY ISSUING A LOCAL STATE  OF  EMERGENCY
 AND  LOCAL  EMERGENCY  ORDERS UNDER SECTION TWENTY-FOUR OF THIS ARTICLE.
 THE LOCAL STATE OF EMERGENCY  AND  LOCAL  EMERGENCY  ORDERS  SHALL  ONLY
 EFFECT PART OR ALL OF THE TERRITORIAL LIMITS OF SUCH LOCAL GOVERNMENT.
   §  3.  This  act  shall take effect immediately and shall apply to any
 executive order issued by the governor on or after January 1, 2025.
