BILL NUMBER: S2017 SPONSOR: WALCZYK TITLE OF BILL: CONCURRENT RESOLUTION OF THE SENATE AND ASSEMBLY proposing an amendment to section 3 of article 14 of the Constitution, in relation to conveying land to the town of Montague, Lewis county, in order to allow the expan- sion of the town's barn for public use PURPOSE OR GENERAL IDEA OF BILL: This bill would amend the New York State Constitution to allow the town of Montague to enter into a land swap agreement with the Department of Environmental Conservation (DEC). SUMMARY OF PROVISIONS: Section 1: Creates a new subdivision 3 within section 3, article 14 of the New York State Constitution to allow the town of Montague to enter into a land swap agreement with DEC. In exchange for 1.2 acres of state land, the town will give DEC 26 acres.

WALCZYK -- read twice and ordered printed, and when printed to be committed to the Committee on Judiciary CONCURRENT RESOLUTION OF THE SENATE AND ASSEMBLY proposing an amendment to section 3 of article 14 of the Constitution, in relation to conveying land to the town of Montague, Lewis county, in order to allow the expansion of the town's barn for public use Section 1. Resolved (if the Assembly concur), That section 3 of arti- cle 14 of the constitution be amended by adding a new subdivision 3 to read as follows: 3. NOTWITHSTANDING THE FOREGOING PROVISIONS AND SUBJECT TO LEGISLATIVE APPROVAL PRIOR TO ACTUAL TRANSFER OF TITLE, THE STATE MAY CONVEY TO THE TOWN OF MONTAGUE, IN THE COUNTY OF LEWIS, FOR PUBLIC USE FOR THE EXPAN- SION OF A TOWN BARN OWNED BY SUCH TOWN, APPROXIMATELY 1.2 ACRES OF FOREST PRESERVE LAND WITHIN SUCH TOWN AND, IN EXCHANGE THEREFOR, THE TOWN OF MONTAGUE SHALL CONVEY TO THE STATE FOR INCORPORATION INTO THE REFORESTATION LANDS APPROXIMATELY TWENTY-SIX ACRES OF LAND, ON THE CONDITION THAT THE LEGISLATURE SHALL DETERMINE THAT THE PROPERTY TO BE RECEIVED BY THE STATE IS AT LEAST EQUAL IN VALUE TO THE LAND TO BE CONVEYED BY THE STATE. § 2. Resolved (if the Assembly concur), That the foregoing amendment be referred to the first regular legislative session convening after the next succeeding general election of members of the assembly, and, in conformity with section 1 of article 19 of the constitution, be published for 3 months previous to the time of such election.
