BILL NUMBER: S2088 SPONSOR: KAVANAGH TITLE OF BILL: An act to amend the general business law, in relation to requiring rental vehicles have any personal information removed from the vehicle once returned PURPOSE: OR GENERAL IDEA OF BILL: The purpose of the bill is to include in a rental agreement that any information uploaded to a vehicle by a renter, must be removed prior to returning the vehicle. SUMMARY OF PROVISIONS: Section 1: Section 396-z of the general business law is amended by adding a new subdivision 17 that requires all rental vehicle companies to include a clause, within rental agreements, that instructs all renters to remove their personal information from vehicles before returning them and allows the option to place a decal within the vehicle

KAVANAGH -- read twice and ordered printed, and when printed to be committed to the Committee on Consumer Protection AN ACT to amend the general business law, in relation to requiring rental vehicles have any personal information removed from the vehicle once returned THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The general business law is amended by adding a new section 391-r to read as follows: § 391-R. PERSONAL INFORMATION ON RENTAL VEHICLES. ANY PERSON, FIRM, PARTNERSHIP, ASSOCIATION OR CORPORATION ENGAGED IN THE BUSINESS OF RENT- ING MOTOR VEHICLES SHALL, UPON RECEIPT OF A RENTAL VEHICLE FROM A CUSTOMER, REMOVE ALL PERSONAL INFORMATION FROM SUCH VEHICLE RELATING TO THE CUSTOMER. § 2. This act shall take effect on the thirtieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD03396-02-5
