BILL NUMBER: S2309 SPONSOR: COMRIE TITLE OF BILL: An act to amend the state finance law, in relation to requiring state agencies that issue requests for proposals to provide notification to elected officials for requests for proposals for projects in excess of ten million dollars PURPOSE: This bill would requires state agencies and authorities that issue RFPs in excess of $10 Million Dollars to notify the elected officials who represent the affected zip codes. COMRIE -- read twice and ordered printed, and when printed to be committed to the Committee on Procurement and Contracts AN ACT to amend the state finance law, in relation to requiring state agencies that issue requests for proposals to provide notification to elected officials for requests for proposals for projects in excess of ten million dollars THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 139-k of the state finance law is amended by adding a new subdivision 7 to read as follows: 7. A. FOR PURPOSES OF THIS SUBDIVISION, THE TERM "STATE AGENCY" SHALL MEAN THE OFFICE OF GENERAL SERVICES, EMPIRE STATE DEVELOPMENT, AND ANY OTHER AGENCY OR INSTRUMENTALITY OF THE STATE AUTHORIZED TO ISSUE REQUESTS FOR PROPOSALS. B. FOR PURPOSES OF THIS SUBDIVISION, THE TERM "ELECTED OFFICIAL" SHALL MEAN ANY PERSON HOLDING PUBLIC OFFICE IN THE STATE'S EXECUTIVE BODY, THE STATE LEGISLATURE, OR IN A LOCAL MUNICIPAL LEGISLATIVE BODY, INCLUDING BUT NOT LIMITED TO, ELECTED COUNTY, CITY, TOWN, OR VILLAGE OFFICIALS. C. ANY STATE AGENCY THAT ISSUES A REQUEST FOR PROPOSALS FOR A PROJECT FOR THE CONSTRUCTION, RECONSTRUCTION, REHABILITATION OR IMPROVEMENT OF FACILITIES WITH A TOTAL PROJECT COST OF TEN MILLION DOLLARS OR MORE SHALL PROVIDE NOTIFICATION TO ELECTED OFFICIALS OF THE ISSUANCE OF SUCH REQUEST FOR PROPOSALS AS PROVIDED IN THIS SUBDIVISION. SUCH NOTIFICATION SHALL BE MADE TO EVERY ELECTED OFFICIAL WHOSE JURISDICTION INCLUDES, IN WHOLE OR IN PART, ANY TERRITORY LOCATED WITHIN THE GEOGRAPHIC AREA OF THE ZIP CODE OR CODES IN WHICH SUCH PROJECT IS LOCATED. SUCH NOTIFICA- TION SHALL BE MADE BY SUCH STATE AGENCY TO SUCH ELECTED OFFICIALS BY EMAIL AND REGULAR MAIL AND SHALL BE MADE AT LEAST THIRTY DAYS BEFORE SUCH REQUEST FOR PROPOSALS IS ISSUED. § 2. This act shall take effect immediately; provided, however, that the amendments made to section 139-k of the state finance law by section one of this act shall not affect the repeal of such section and shall be deemed repealed therewith.
