TITLE OF BILL:

An act to amend the state administrative procedure act, in relation to
enacting the "red tape reduction act"

 
PURPOSE:

This legislation would require that when a rule is adopted that imposes
a new administrative burden on a business, one or more existing rules
must be amended or repealed to offset the cost of the new administrative
burden. Also requires the identification of the rule to be repealed
whenever a new rule is proposed.

 
SUMMARY OF SPECIFIC PROVISIONS:

Section 1 titles this the red tape reduction act

Section 2 states that if a rule is adopted that imposes a new adminis-
trative burden on a business, one or more existing rules must be amended
              

or repealed to offset the cost of the new administrative burden. This
section also states that every notice of proposed rulemaking includes
the existing rule or regulation to be amended or repealed to offset the
cost of the new administrative burden. Further language clarifies that
repeal of a rule shall not compromise public health, safety or economy
of the state or its citizens.

Section 3 is the effective date.

 
JUSTIFICATION:

Various rules enacted by state agencies often have a negative impact on
the ability of business to function. This legislation which is patterned
after a law passed in Canada will alleviate much of the administrative
burden a business faces whenever a new rule is adopted. This legislation
fully allows for new rules but requires already existing rules to be
taken into account. Enactment of this legislation would go a long way to
improving New York's business climate.

EFFECTIVE DATE:
This act shalt take effect immediately and shall apply to notices of
proposed rulemaking submitted on or after such date.
