BILL NUMBER: S2396 SPONSOR: PERSAUD TITLE OF BILL: An act to amend the social services law, in relation to creating case- load standards for adult protective services workers SUMMARY OF PROVISIONS: Section one of this bill amends section 20-a of the Social Services Law to provide that such section will not apply to any regulations estab- lishing caseload standards. Section two of this bill amends section 421 of the Social Services Law by adding a new subdivision to create caseload standards for adult protective services, which shall be no more twenty initial investi- gations at any given time, or more than thirty ongoing cases at any given time, or a total caseload of more than thirty cases. Section three of this bill amends adds a new section to article 9-B of the Social Services Law to require the annual reporting of adult protec- tive services statistics, including the average number of active cases

PERSAUD -- read twice and ordered printed, and when printed to be committed to the Committee on Social Services AN ACT to amend the social services law, in relation to creating case- load standards for adult protective services workers THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 20-a of the social services law, as added by chap- ter 107 of the laws of 1971, is amended to read as follows: § 20-a. Local personnel; limitations on department's power. Notwith- standing any inconsistent provision of this chapter, the board, the commissioner or the department, acting singly or in unison, shall not have the power, directly or indirectly to prescribe the number of persons to be employed in any social services district providing the district complies with the minimum federal standards relating thereto; PROVIDED, HOWEVER, THAT THE PROVISIONS OF THIS SECTION SHALL NOT APPLY TO THE REGULATIONS OF THE OFFICE OF CHILDREN AND FAMILY SERVICES ESTAB- LISHING CASELOAD STANDARDS FOR ADULT PROTECTIVE SERVICES WORKERS PROMUL- GATED PURSUANT TO PARAGRAPH (A) OF SUBDIVISION NINE OF SECTION FOUR HUNDRED TWENTY-ONE OF THIS CHAPTER. § 2. Section 421 of the social services law is amended by adding a new subdivision 9 to read as follows: 9. PROMULGATE REGULATIONS, IN CONSULTATION WITH LOCAL SOCIAL SERVICES DISTRICTS, RELATING TO CASELOAD STANDARDS FOR ADULT PROTECTIVE SERVICES WORKERS. SUCH STANDARDS SHALL INCLUDE, BUT NOT BE LIMITED TO: (A) LIMITATIONS ON THE NUMBER OF INVESTIGATIONS WHICH CAN BE ASSIGNED TO ADULT PROTECTIVE SERVICES WORKERS, PROVIDED HOWEVER, TO THE EXTENT POSSIBLE AND WITHIN AMOUNTS APPROPRIATED THEREFOR, A FULL TIME EQUIV- ALENT ADULT PROTECTIVE SERVICES WORKER SHALL NOT BE ASSIGNED: (I) A CASELOAD OF MORE THAN TWENTY INITIAL INVESTIGATIONS AT ANY GIVEN TIME; OR EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
