   printed to be committed to the Committee on Housing, Construction  and

 AN  ACT to amend the vehicle and traffic law, in relation to prohibiting
   the operation of a bicycle while under the  influence  of  alcohol  or
   drugs

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 1242-a of the vehicle and traffic law, as added  by
 section  9  of  part XX of chapter 58 of the laws of 2020, is amended to
 read as follows:
   § 1242-a. Operation of a BICYCLE OR bicycle with electric assist while
 under the influence of alcohol or drugs. 1.  Offenses;  criminal  penal-
 ties.  (a)  Operating  a  BICYCLE  OR bicycle with electric assist while
 ability impaired. No person shall operate  a  BICYCLE  OR  bicycle  with
 electric  assist  while  the person's ability to operate such BICYCLE OR
 bicycle with electric assist is impaired by the consumption of alcohol.
   (i) A violation of this paragraph shall be a  traffic  infraction  and
 shall be punishable by a fine of not more than three hundred dollars, or
 by  imprisonment  in  a  penitentiary  or  county jail for not more than
 fifteen days, or by both such fine and imprisonment.
   (ii) A person who operates a BICYCLE OR bicycle with  electric  assist
 in  violation  of  this  paragraph  after  having  been  convicted  of a
 violation of any paragraph of this subdivision within the preceding five
 years shall be punished by a fine of not more than seven  hundred  fifty
 dollars, or by imprisonment of not more than thirty days in a penitenti-
 ary or county jail or by both such fine and imprisonment.
   (iii)  A person who operates a BICYCLE OR bicycle with electric assist
 in violation of this paragraph after being convicted two or  more  times
 of a violation of any paragraph of this subdivision within the preceding
 ten  years  shall be guilty of a misdemeanor, and shall be punished by a
