BILL NUMBER: S2585 SPONSOR: LIU TITLE OF BILL: An act to amend the civil service law, in relation to the definition of public employer and public employee PURPOSE OR GENERAL IDEA OF BILL: This bill will amend CVS-75b to include all employees of judges, justices of the unified court system, and members of the legislature as "public employees," so that workers may report misconduct without fear of retaliation. SUMMARY OF PROVISIONS: This hill will include all employees of judges, justices of the unified court system, and members of the legislature within the definition of a "public employee" or "employee."

LIU, BROUK, COMRIE, HOYLMAN-SIGAL, MAYER, RIVERA, SEPULVEDA -- read twice and ordered printed, and when printed to be committed to the Committee on Civil Service and Pensions AN ACT to amend the civil service law, in relation to the definition of public employer and public employee THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraphs (a) and (b) of subdivision 1 of section 75-b of the civil service law, as added by chapter 660 of the laws of 1984, are amended to read as follows: (a) "Public employer" or "employer" shall mean (i) the state of New York, (ii) a county, city, town, village or any other political subdivi- sion or civil division of the state, (iii) a school district or any governmental entity operating a public school, college or university, (iv) a public improvement or special district, (v) a public authority, commission or public benefit corporation, [or] (vi) THE UNIFIED COURT SYSTEM, (VII) THE LEGISLATURE, OR (VIII) any other public corporation, agency, instrumentality or unit of government which exercises govern- mental power under the laws of the state. (b) "Public employee" or "employee" shall mean any person, WITH THE EXCEPTIONS OF A JUDGE OR JUSTICE OF THE UNIFIED COURT SYSTEM AND MEMBERS OF THE LEGISLATURE, holding a position by appointment or employment in the service of a public employer [except judges or justices of the unified court system and members of the legislature]. § 2.
