TITLE OF BILL:

An act to amend the education law, in relation to providing site mapping
for emergency response data relating to school safety plans

 
PURPOSE:

To require school safety plans to include more detailed mapping informa-
tion. SUMMARY OF PROVISIONS:

Section one amends section 2801-a of the education law to require school
safety plans to include site mapping for emergency response data and
provide guidelines for the creation and sharing of such digitized maps
with law enforcement.

Section two amends section 2801-a of the education law by adding subdi-
vision 11 which defines site mapping for emergency response.

Section three amends section 3602 of the education law to make costs
associated with furnishing site mapping for emergency response data

eligible for building aid.

Section four sets forth the effective date.

 
JUSTIFICATION:

New York has taken steps to enhance school safety through community
outreach programs, social workers and school resource officers, improv-
ing the safety infrastructure of our school buildings, and by passing
common sense gun legislation to protect all of our communities from the
tragic violence we've seen across the country.

Under current law, schools are already required to establish safety
plans. This legislation will require those plans to provide real-time
digital blueprints of a building and its surrounding areas. By sharing
digitized maps of school grounds, this data will enable law enforcement
and first responders to act quickly and collaborate more efficiently in
an emergency, such as active shooter situations or fires.

Similar legislation has recently been enacted in New Jersey, Virginia,
Delaware, Michigan, and Wisconsin.

 AN ACT to amend the education law, in relation to providing site mapping
   for emergency response data relating to school safety plans
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The opening paragraph and paragraph c of subdivision 3 of
 section 2801-a of the education law, as amended by section 1 of  part  B
 of chapter 54 of the laws of 2016, are amended to read as follows:
   A  building  level emergency response plan, developed by the building-
 level emergency response  team  defined  in  subdivision  four  of  this
 section,  shall  be  kept confidential, including but not limited to the
 [floor plans, blueprints, schematics or other maps of the school interi-
 or, school grounds and road maps of  the  immediate  surrounding  area,]
 SITE  MAPPING  FOR  EMERGENCY  RESPONSE DESCRIBED IN PARAGRAPH C OF THIS
 SUBDIVISION and shall not be disclosed except to  authorized  department
 or  school  staff,  and  law enforcement officers, and shall include the
 following elements:
   c. SITE MAPPING FOR EMERGENCY RESPONSE, INCLUDING floor  plans,  blue-
 prints,  schematics or other maps of the school interior, school grounds
 and road maps of the immediate surrounding area. SUCH SITE MAPS SHALL BE
 PROVIDED IN A FORMAT COMPATIBLE WITH SOFTWARE PLATFORMS USED  BY  LOCAL,
 STATE,   COUNTY, AND FEDERAL LAW ENFORCEMENT AGENCIES THAT PROVIDE EMER-
 GENCY SERVICES TO THE SPECIFIC SCHOOL FOR WHICH  THE  DATA  IS  PROVIDED
 WITHOUT  REQUIRING LAW ENFORCEMENT AGENCIES TO PURCHASE ADDITIONAL SOFT-
 WARE OR REQUIRING THE INTEGRATION OF THIRD-PARTY SOFTWARE  TO  VIEW  THE
 DATA,  AND  COMPATIBLE  WITH  SECURITY  SOFTWARE PLATFORMS IN USE BY THE
 SPECIFIC SCHOOL FOR WHICH THE DATA IS PROVIDED  WITHOUT  REQUIRING  SUCH
 SCHOOL  AND  LAW ENFORCEMENT AGENCIES TO PURCHASE ADDITIONAL SOFTWARE OR
 
  EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets

 REQUIRING THE INTEGRATION OF THIRD-PARTY SOFTWARE TO VIEW THE DATA. SUCH
 SITE MAPS SHALL BE PROVIDED IN A PRINTABLE FORMAT, ORIENTED TRUE  NORTH,
 BE  OVERLAID  WITH GRIDDED X/Y COORDINATES, AND BE VERIFIED FOR ACCURACY
 THROUGH  AN  INITIAL  AND ANNUAL WALKTHROUGH OF ALL SCHOOL BUILDINGS AND
 GROUNDS. DISTRICTS SHALL MAKE EVERY EFFORT TO PROVIDE:
   I. UP-TO-DATE FLOOR PLANS OVERLAID ON  CURRENT  AERIAL  IMAGERY  OF  A
 SCHOOL BUILDING AND GROUPS;
   II.  SITE  SPECIFIC  LABELING THAT MATCHES THE STRUCTURE OF THE SCHOOL
 BUILDING, INCLUDING BUILDING ACCESS POINTS, ROOM LABELS, HALLWAY  NAMES,
 EXTERNAL DOOR OR STAIRWELL NUMBERS, LOCATIONS OF HAZARDOUS MATERIALS AND
 UTILITY  SHUT  OFFS,  KEY  BOXES, AUTOMATED EXTERNAL DEFIBRILLATORS, AND
 TRAUMA KITS; AND
   III. SITE SPECIFIC LABELING THAT MATCHES THE SCHOOL GROUNDS, INCLUDING
 PARKING AREAS, ATHLETIC FIELDS, SURROUNDING ROADS, AND NEIGHBORING PROP-
 ERTIES.
   § 2. Section 2801-a of the education law is amended by  adding  a  new
 subdivision 11 to read as follows:
   11.  FOR  PURPOSES  OF  THIS  SECTION,  "SITE  MAPPING  FOR  EMERGENCY
 RESPONSE" MEANS INFORMATION PROVIDED IN AN ELECTRONIC OR DIGITAL  FORMAT
 TO ASSIST LAW ENFORCEMENT OR EMERGENCY FIRST RESPONDERS IN AN EMERGENCY.
   §  3. Subdivision 6-c of section 3602 of the education law, as amended
 by chapter 1 of the laws of 2013, and paragraph b as amended by  section
 9  of  part  A  of chapter 56 of the laws of 2023, is amended to read as
 follows:
   6-c. a. Building aid for metal detectors,  [and]  safety  devices  for
 electrically  operated  partitions,  room  dividers  and doors, AND SITE
 MAPPING FOR EMERGENCY RESPONSE.  In addition to the apportionments paya-
 ble to a school district pursuant to subdivision six  of  this  section,
 the  commissioner  is  hereby  authorized  to  apportion  to  any school
 district additional building aid pursuant to this  subdivision  for  its
 approved  expenditures  in  the base year for the purchase of stationary
 metal detectors, security cameras, safety devices for electrically oper-
 ated partitions and room dividers  required  pursuant  to  section  four
 hundred  nine-f  of  this chapter, or other security devices approved by
 the commissioner that increase the safety of students and school person-
 nel, AND FOR FURNISHING SITE MAPPING FOR EMERGENCY RESPONSE AS  REQUIRED
 BY SUBDIVISION THREE OF SECTION TWO THOUSAND EIGHT HUNDRED ONE-A OF THIS
 CHAPTER,  provided,  however, that funds apportioned to school districts
 pursuant to this section shall not supplant funds for existing  district
 expenditures or for existing contractual obligations of the district for
 stationary metal detectors, security cameras, partition and room divider
 safety  devices,  [or]  security  devices, OR SITE MAPPING FOR EMERGENCY
 RESPONSE.  Portable or [hand held] HANDHELD metal detectors shall not be
 eligible for aid pursuant to this subdivision. Such additional aid shall
 equal the product of the building aid ratio  computed  for  use  in  the
 current  year pursuant to paragraph c of subdivision six of this section
 and the actual approved expenditures incurred in the base year  pursuant
 to  this  subdivision,  provided that the limitations on cost allowances
 prescribed by paragraph a of subdivision six of this section  shall  not
 apply.  The  commissioner shall annually prescribe a special cost allow-
 ance for metal detectors, and security cameras, and the approved expend-
 itures shall not exceed such  cost  allowance.  The  commissioner  shall
 annually  prescribe  a  special  cost  allowance  for partition and room
 divider safety devices, and the approved expenditures shall  not  exceed
 such  cost  allowance.    THE  COMMISSIONER  SHALL  ANNUALLY PRESCRIBE A

 SPECIAL COST ALLOWANCE FOR SITE MAPPING FOR EMERGENCY RESPONSE, AND  THE
 APPROVED EXPENDITURES SHALL NOT EXCEED SUCH COST ALLOWANCE.
   b.  For  projects  approved  by the commissioner authorized to receive
 additional building aid pursuant to this subdivision for the purchase of
 stationary metal detectors, security cameras or other  security  devices
 approved  by  the  commissioner that increase the safety of students and
 school personnel, provided that for  purposes  of  this  paragraph  such
 other  security  devices shall be limited to electronic security systems
 and hardened doors, and provided  that  for  projects  approved  by  the
 commissioner  on  or  after  the first day of July two thousand thirteen
 such additional aid shall equal the product  of  (i)  the  building  aid
 ratio  computed  for  use in the current year pursuant to paragraph c of
 subdivision six of this section plus ten percentage points, except  that
 in  no  case  shall this amount exceed one hundred percent, and (ii) the
 actual approved expenditures incurred in the base year pursuant to  this
 subdivision, provided that the limitations on cost allowances prescribed
 by  paragraph  a of subdivision six of this section shall not apply, and
 provided further that any projects aided under this  paragraph  must  be
 included  in  a  district's  school  safety plan. The commissioner shall
 annually prescribe a special cost allowance  for  metal  detectors,  and
 security  cameras,  and  the approved expenditures shall not exceed such
 cost allowance.
   § 4. This act shall take effect six months after it shall have  become
 a law.
