BILL NUMBER: S2665 SPONSOR: SALAZAR TITLE OF BILL: An act to amend the public buildings law, in relation to requiring gender neutral bathrooms in state-owned buildings PURPOSE: To require that all government owned and operated buildings and facili- ties have at least one all gender restroom. SUMMARY OF PROVISIONS: Section 1 amends section 145 of the public buildings law by adding a new paragraph e to subdivision 1 and adding a new subdivision 3 to require at least one all gender multiple-occupancy bathroom in state-owned and state-leased buildings where there are no all gender single-occupancy bathrooms. Section 2 provides the effective date.

SALAZAR -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to amend the public buildings law, in relation to requiring gender neutral bathrooms in state-owned buildings THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The section heading of section 145 of the public buildings law, as amended by chapter 14 of the laws of 2020, is amended, subdivi- sion 1 is amended by adding a new paragraph (e), and two new subdivi- sions 3 and 4 are added to read as follows: Gender neutral [single-occupancy] bathrooms. (E) "MULTIPLE-OCCUPANCY BATHROOM" MEANS A ROOM OR SUITE OF ROOMS CONTAINING AT LEAST ONE SINK AND AT LEAST TWO SANITARY FIXTURES, SUCH AS TOILETS OR URINALS, INTENDED FOR SIMULTANEOUS USE BY TWO OR MORE OCCU- PANTS. 3. IF NO SINGLE-OCCUPANCY BATHROOM CAN BE DESIGNATED AS GENDER NEUTRAL IN A STATE-OWNED BUILDING, A MULTIPLE-OCCUPANCY BATHROOM SHALL BE DESIG- NATED AS GENDER NEUTRAL INSTEAD. 4. ADEQUATE NOTICE SHALL BE PROVIDED IN EVERY STATE-OWNED AND STATE- LEASED BUILDING SO THAT ALL PERSONS CAN REASONABLY FIND BATHROOMS THAT HAVE BEEN DESIGNATED AS GENDER NEUTRAL. § 2.
