TITLE OF BILL:

An act to amend the executive law, in relation to requiring certain
state owned and operated parking facilities to install and maintain
charging stations for plug-in electric vehicles

 
PURPOSE OR GENERAL IDEA OF BILL:

This bill would require all New York State owned and operated parking
garages, open parking lots and other parking facilities to install and
maintain a set amount of charging stations for Plug-In Electric Vehi-
cles.

 
SUMMARY OF SPECIFIC PROVISIONS:

Section 1: Requires any parking garage, open parking lot and other park-
ing facility owned and/or operated by the State of New York, that offers
between 50 and 200 parking spaces for the purposes of public use, state
employee use and pay-per-usage, is hereby required to install electric

charging stations in at least 10 percent of the total number of parking
spaces offered by such facility

Section 2: Requires any parking garage, open parking lot and other park-
ing facility owned and/or operated by the State of New York, that offers
more than 200 parking spaces for the purposes of public use, state
employee use and pay-per-usage, is hereby required to install electric
charging stations in at least 20 percent of the total number of parking
spaces offered by such facility.

Section 3: Sets forth electrical supply and capacity standards for Elec-
tric Vehicle Supply Equipment in open parking lots and other open air
parking facilities.

Section 4: Sets forth electrical supply and capacity standards for Elec-
tric Vehicle Supply Equipment in parking garages.

Section 5: Provides for the installation of Electric Vehicle Supply
Equipment by the Office of General Services or licensed contracting
agency.

Section 6: Provides for the operation, maintenance and repair of Elec-
tric Vehicle Supply Equipment by the Office of General Services or
licensed contacting agency.

Bill Section 2: This act shall take effect April 1 of the following
year.

 
JUSTIFICATION:

The number of alternative fuel vehicles on the road in both New York
State and across the country has grown significantly over the past
decade. Specifically, Plug-In Electric Vehicles (those that are powered
by an electric fuel cell and can be recharged) are in increasingly high
demand, and market forecast studies conducted by Navigant Research find
that by 2022 2.3 percent of total vehicle sales in the United States are

expected to be Plug-In Electric Vehicles (PEV's) and that New York State
will sell 144,690 PEV's between 2013 and 2022.

Given the large number of PEV vehicles that currently are and will be on
the road by 2020, it is cur duty as a national leader in renewable ener-
gy to provide the citizens of this state, as well as visitors, with
proper resources for them to recharge their vehicles. This bill will
promote individuals who were previously concerned with charging station
limitations within the state to purchase clean energy vehicles, both
boosting the economy through increases in private and state taxable
revenue on the sales of such PEV's. Lastly, this Legislation will bring
New York State up to par with other energy efficient states such as
California and Texas, who are already installing charging stations in an
effort to promote clean and renewable energy and reduce carbon emis-
sions.

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The executive law is amended by adding a new section  201-b
 to read as follows:
   §  201-B.  ELECTRIC  VEHICLE CHARGING STATIONS. 1. FOR THE PURPOSES OF
 THIS SECTION, THE TERM "PARKING FACILITY" SHALL MEAN A  PARKING  GARAGE,
 PARKING      STRUCTURE, OR OPEN PARKING LOT THAT IS PAVED AND STRIPED TO
 DESIGNATE   INDIVIDUAL PARKING SPACES FOR VEHICLES AND WHICH  HAS  FIFTY
 PARKING SPACES OR MORE.
   2.  ANY  PARKING FACILITY OWNED AND OPERATED BY THE STATE OF NEW YORK,
 THAT OFFERS BETWEEN  FIFTY  AND  TWO  HUNDRED  PARKING  SPACES  FOR  THE
 PURPOSES  OF PUBLIC USE, STATE EMPLOYEE USE AND PAY-PER-USAGE, IS HEREBY
 REQUIRED TO INSTALL ELECTRIC CHARGING STATIONS IN AT LEAST  TEN  PERCENT
 OF THE TOTAL NUMBER OF PARKING SPACES OFFERED BY SUCH FACILITY.
   3.  ANY  PARKING FACILITY OWNED AND OPERATED BY THE STATE OF NEW YORK,

 TRIC VEHICLE CHARGING STATIONS AND ALL OTHER COMPONENTS AND WORK  APPUR-
 TENANT THERETO SHALL BE IN ACCORDANCE WITH ALL APPLICABLE STATE, COUNTY,
 CITY, TOWN, OR VILLAGE ELECTRICAL CODES.

   5. THE OFFICE OF GENERAL SERVICES SHALL BE RESPONSIBLE FOR THE INSTAL-
 LATION  OF  ANY ELECTRIC VEHICLE SUPPLY EQUIPMENT AND CHARGING STATIONS.
 IF SUCH INSTALLATION SHALL REQUIRE THE STATE TO  MAKE  UPGRADES  TO  ANY
 ELECTRICAL SUPPLY EQUIPMENT TO SAFELY AND SUFFICIENTLY POWER AND OPERATE
 SUCH  CHARGING  STATIONS,  THE OFFICE OF GENERAL SERVICES SHALL INCREASE
 THE ELECTRICAL CAPACITY OF THE EXISTING SYSTEM BY INSTALLING NEW  COMPO-
 NENTS  AS NECESSARY. IF THE OFFICE OF GENERAL SERVICES IS UNABLE TO MAKE
 SUCH TECHNICAL UPGRADES TO A FACILITY, THE OFFICE MAY  CONTRACT  WITH  A
 LICENSED  ELECTRICIAN  OR  SIMILAR SERVICE PROVIDER TO UPGRADE THE ELEC-
 TRICAL CAPACITY OF SAID FACILITY. SUCH CONTRACTED WORK SHALL COMPLY WITH
 THE PROVISIONS OF ARTICLE EIGHT OF THE LABOR LAW, INCLUDING THE  PAYMENT
 OF  A  WAGE  OF  NOT LESS THAN THE PREVAILING WAGE IN THE LOCALITY WHERE
 SUCH PARKING FACILITY IS LOCATED.
   6. THE OFFICE OF GENERAL SERVICES SHALL BE RESPONSIBLE FOR THE MAINTE-
 NANCE, GENERAL UPKEEP AND REPAIR OF ANY ELECTRIC VEHICLE  SUPPLY  EQUIP-
 MENT  AND CHARGING STATIONS. IF THE OFFICE OF GENERAL SERVICES IS UNABLE
 TO COMPLETE SUCH MAINTENANCE OR REPAIRS, THE OFFICE MAY CONTRACT WITH  A
 LICENSED ELECTRICIAN OR SIMILAR REPAIR SERVICE TO COMPLETE THE NECESSARY
 WORK ON SAID EQUIPMENT.
   §  2. This act shall take effect on the first of April next succeeding
 the date upon which it shall have become a law.

TITLE OF BILL:

An act to amend the executive law, in relation to requiring certain

PURPOSE OR GENERAL IDEA OF BILL:

This bill would require all New York State owned and operated parking
facilities to install a set amount of electric vehicle charging
stations.

 
SUMMARY OF SPECIFIC PROVISIONS:

Sec. 1- adds a new section 201-b to the executive law requiring the
installation of electric vehicle charging stations in state owned and
operated parking facilities and would provide a definition of "parking
facility" for the purposes of this section; sets forth requirements for
the amount of electric vehicle charging stations or total charging

capacity that must be installed respective to the number of parking
spaces within the parking facility

Sec. 2 - effective date.
