BILL NUMBER: S3042 SPONSOR: HOYLMAN-SIGAL TITLE OF BILL: An act to amend the state finance law, in relation to requiring state agencies to prepare an active intelligence speed assistance system plan PURPOSE: Requiring the use of active intelligent speed assist programs in state- owned vehicles. SUMMARY OF PROVISIONS: Section 1. Amends section 163-e of the finance law to add a new defi- nition of active intelligent speed assistance system. Amends section 163-e of the finance law to require the preparation of plans to imple- ment active intelligent speed assistance systems in light and heavy-duty vehicles. Amends section 163-e of the finance law to require the imple- mentation of the plans detailed in section 2.

HOYLMAN-SIGAL -- read twice and ordered printed, and when printed to be committed to the Committee on Procurement and Contracts AN ACT to amend the state finance law, in relation to requiring state agencies to prepare an active intelligence speed assistance system plan THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The state finance law is amended by adding a new section 163-e to read as follows: § 163-E. ACTIVE INTELLIGENT SPEED ASSISTANCE SYSTEM FOR STATE-OWNED VEHICLES. 1. FOR PURPOSES OF THIS SECTION, THE TERM "ACTIVE INTELLIGENT SPEED ASSISTANCE SYSTEM" MEANS A VEHICLE SYSTEM THAT USES, AT MINIMUM, THE GPS LOCATION OF THE VEHICLE COMPARED WITH A DATABASE OF POSTED SPEED LIMITS, TO DETERMINE THE SPEED LIMIT, AND PREVENTS THROTTLE INPUT ONCE A VEHICLE EXCEEDS A SPECIFIED SPEED THRESHOLD RELATED TO THE SPEED LIMIT. AN ACTIVE INTELLIGENT SPEED ASSISTANCE SYSTEM SHALL BE CAPABLE OF BEING TEMPORARILY DISABLED BY THE DRIVER OF THE VEHICLE. 2. EACH STATE AGENCY SHALL PREPARE AN ACTIVE INTELLIGENT SPEED ASSIST- ANCE SYSTEM PLAN FOR THE EQUIPMENT OF ALL STATE AGENCY VEHICLES WITH ACTIVE INTELLIGENT SPEED ASSISTANCE SYSTEMS. THE STATE FLEET ACTIVE INTELLIGENT SPEED ASSISTANCE SYSTEM PLAN FOR LIGHT-DUTY NON-EMERGENCY VEHICLES SHALL BE PREPARED ON OR BEFORE DECEMBER THIRTY-FIRST, TWO THOU- SAND TWENTY-SEVEN, AND THE STATE FLEET ACTIVE INTELLIGENT SPEED ASSIST- ANCE SYSTEM PLAN FOR MEDIUM- AND HEAVY-DUTY VEHICLES SHALL BE PREPARED ON OR BEFORE DECEMBER TWO THOUSAND TWENTY-EIGHT. SUCH PLANS SHALL INCLUDE INTERIM TARGETS FOR ACHIEVING THE EQUIPMENT OF ALL STATE AGENCY VEHICLES WITH ACTIVE INTELLIGENT SPEED ASSISTANCE SYSTEMS. 3. ALL STATE AGENCY LIGHT-DUTY NON-EMERGENCY VEHICLES SHALL BE EQUIPPED WITH ACTIVE INTELLIGENT SPEED ASSISTANCE SYSTEMS BY NO LATER THAN DECEMBER THIRTY-FIRST, TWO THOUSAND THIRTY, AND ALL STATE AGENCY EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
