BILL NUMBER: S315 SPONSOR: SKOUFIS TITLE OF BILL: An act to amend the alcoholic beverage control law, in relation to establishing a temporary New York craft beverage permit PURPOSE: To allow a temporary New York craft beverage permit for all New York state-manufactured liquor, spirits, wine, beer, cider, and mead for events located in a municipality with a population of less than one million. SUMMARY OF PROVISIONS: Section 1: Authorizes the state liquor authority to issue temporary permits to a licensed New York state farm distillery, brewery, winery, cidery or meadery, effective for a period not longer than 24 hours at outdoor or indoor gatherings, functions, occasions, or events located in a municipality with less than one million people. Charges a fee of $50

SKOUFIS, BORRELLO, COONEY, HINCHEY, MAY, MYRIE, PERSAUD, ROLISON, STEC, WEBB -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Government Operations AN ACT to amend the alcoholic beverage control law, in relation to establishing a temporary New York craft beverage permit THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The alcoholic beverage control law is amended by adding a new section 97-e to read as follows: § 97-E. TEMPORARY NEW YORK CRAFT BEVERAGE PERMIT. THE LIQUOR AUTHORITY IS HEREBY AUTHORIZED TO ISSUE TEMPORARY PERMITS TO A LICENSED NEW YORK STATE FARM DISTILLERY, BREWERY, WINERY, CIDERY OR MEADERY, EFFECTIVE FOR A PERIOD NOT TO EXCEED TWENTY-FOUR CONSECUTIVE HOURS TO AUTHORIZE THE SALE OF ALL NEW YORK STATE MANUFACTURED LIQUOR, SPIRITS, WINE, BEER, CIDER AND MEAD, AS AUTHORIZED TO BE SOLD IN NEW YORK TASTING ROOMS, AT OUTDOOR OR INDOOR GATHERINGS, FUNCTIONS, OCCASIONS OR EVENTS LOCATED IN A MUNICIPALITY WITH A POPULATION OF LESS THAN ONE MILLION, WITHIN THE HOURS FIXED BY OR PURSUANT TO SUBDIVISION FIVE OF SECTION ONE HUNDRED SIX OF THIS CHAPTER, DURING WHICH ALCOHOLIC BEVERAGES MAY LAWFULLY BE SOLD OR SERVED UPON PREMISES LICENSED TO SELL ALCOHOLIC BEVERAGES AT RETAIL FOR ON-PREMISES CONSUMPTION IN THE COMMUNITY IN WHICH IS LOCATED THE PREMISES IN WHICH SUCH GATHERING, FUNCTION, OCCASION OR EVENT IS HELD. THE FEE FOR SUCH PERMIT SHALL BE FIFTY DOLLARS. PERMITTEES SHALL PROMINENTLY DISPLAY THEIR NEW YORK STATE FARM DISTILLERY, BREWERY, WINERY, CIDERY OR MEADERY PERMIT AT THE TEMPORARILY PERMITTED EVENT FOR INSPECTION BY ANY REGULATORY AGENCY. SUCH PERMIT AND THE EXERCISE OF THE PRIVILEGE GRANTED THEREBY SHALL BE SUBJECT TO SUCH RULES OF THE LIQUOR AUTHORITY AS IT DEEMS NECESSARY. § 2. This act shall take effect immediately.
