TITLE OF BILL:

An act to amend the town law, in relation to dissolution of the Jenkins
Park District by the town of Ballston, in the county of Saratoga

 
PURPOSE OR GENERAL IDEA OF BILL:

This bill will amend the town law of the town of Ballston, in Saratoga
County, to allow for the dissolution of the Jenkins Park District in
Ballston.

 
SUMMARY OF PROVISIONS:

Section 1 amends section 202-c of the town law of the town of Ballston,
by adding a' new subdivision 2-h which allows for the town of Ballston
board to dissolve the Jenkins Park District according to the procedures
outlined.

Section 2 provides that the bill shall take effect immediately.

 
JUSTIFICATION:

Town of Ballston Law Section 202-c contains provisions of law governing
dissolution of the areas of certain districts, and Subdivision 2 of this
section provides that a Town Board may, upon its own motion, after
public hearing, dissolve a park district provided that three years have
elapsed since the establishment and that no improvement has been
constructed or service provided, and no indebtedness is outstanding on
behalf of the park district. Jenkins Park within the town of Ballston,
also known as District Park No. 1 was formed on September 13, 1954. The
genesis of the formation was a petition signed by resident owners of the
town requesting this park district. Over the years Park District No. I
was the subject of many deeds including in 1977 when one stated the park
is governed by the Town Board and duties regarding operation/maintenance
are assigned to the town. Where improvements have been made the current
law does not allow for the discontinuance of the district, and it
requires a special act of the state legislature. Circumstances here
warrant dissolution as the park is improved by pavilions, playgrounds
and other amenities benefitting the entire community, but approximately
only 500 property owners currently find the park through a special
district tax, when the entire community now uses it.  There is no
indebtedness associated with Park District No. 1 either.  Therefore,
this bill is needed as Baliston's only approach to resolve this inequity
is through legislative action.

 AN ACT to amend the town law, in relation to dissolution of the  Jenkins
   Park District by the town of Ballston, in the county of Saratoga
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 202-c of the town law is amended by  adding  a  new
 subdivision 2-h to read as follows:
   2-H.  NOTWITHSTANDING ANY OTHER PROVISION OF GENERAL, SPECIAL OR LOCAL
 LAW, RULE OR REGULATION TO THE CONTRARY, WHENEVER THE TOWN BOARD OF  THE
 TOWN  OF  BALLSTON,  SARATOGA  COUNTY,  SHALL  DETERMINE IT TO BE IN THE
 PUBLIC INTEREST, SAID TOWN BOARD MAY, UPON ITS OWN  MOTION  AND  WITHOUT
 PETITION,  BUT  AFTER  A  PUBLIC HEARING HELD IN THE MANNER AND UPON THE
 NOTICE SPECIFIED IN  SUBDIVISION  ONE  OF  THIS  SECTION,  DISSOLVE  AND
 DISCONTINUE  THE JENKINS PARK DISTRICT, OTHERWISE KNOWN AS PARK DISTRICT
 NO. 1, PROVIDED THAT THERE BE NO INDEBTEDNESS, OUTSTANDING  AND  UNPAID,
 INCURRED TO ACCOMPLISH ANY OF THE PURPOSES OF SUCH DISTRICT.
   § 2. This act shall take effect immediately.
