GIANARIS -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to human-relevant research funding for scientific testing on animals; and to amend the state finance law, in relation to establishing the promoting ethical testing solutions fund THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. This act shall be known and may be cited as the "promoting ethical testing solutions (P.E.T.S) act". § 2. The public health law is amended by adding a new section 504-a to read as follows: § 504-A. HUMAN-RELEVANT RESEARCH FUNDING FOR SCIENTIFIC TESTING ON ANIMALS. 1. FOR THE PURPOSES OF THIS SECTION, THE FOLLOWING TERMS SHALL HAVE THE FOLLOWING MEANINGS: (A) "ANIMAL" SHALL MEAN ANY LIVING CREATURE OTHER THAN A HUMAN. (B) "ANIMAL TESTING" SHALL MEAN THE USE OF LIVE ANIMALS IN SCIENTIFIC TESTS, EXPERIMENTS OR INVESTIGATIONS. (C) "CORPORATION" SHALL MEAN THE EMPIRE STATE DEVELOPMENT CORPORATION. (D) "FUND" SHALL MEAN THE PROMOTING ETHICAL TESTING SOLUTIONS FUND. 2. (A) THE CORPORATION AND THE STATE COMPTROLLER SHALL ESTABLISH AND ADMINISTER A NONLAPSING REVOLVING FUND WHICH SHALL BE KNOWN AS THE PROMOTING ETHICAL TESTING SOLUTIONS FUND. (B) THE PURPOSE OF THE FUND SHALL BE TO PROMOTE STATE-FUNDED RESEARCH INTENDED TO DEVELOP HUMAN-RELEVANT ALTERNATIVES TO USING NON-HUMAN ANIMALS IN SCIENTIFIC MEDICAL AND PRODUCT TESTING AND RESEARCH THROUGH GRANTS AND LOANS TO PUBLIC AND PRIVATE ENTITIES IN THE STATE. (C) MONIES IN THE FUND SHALL CONSIST OF: (I) REVENUE DISTRIBUTED TO THE FUND; (II) MONEY IN THE STATE BUDGET APPROPRIATED TO THE FUND IN ACCORDANCE WITH THE PROVISIONS OF THE STATE BUDGET FOR EACH FISCAL YEAR; EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
