BILL NUMBER: S4389 SPONSOR: MAY TITLE OF BILL: An act to amend the executive law, in relation to ensuring that color vision requirements for appointment of police officers are tailored to only eliminate individuals with extreme color vision deficiencies from eligibility PURPOSE: The purpose of this bill is to make candidacy in law enforcement acces- sible to eligible individuals with color vision deficiencies by provid- ing practical field examinations as an alternative to clinical diagnos- tic testing in the medical review process. SUMMARY OF PROVISIONS: The bill amends section 840 of the executive law by adding a new subdi- vision 2-c, which specifies that the promulgation of rules and/or regu- lations relating to color vision requirements for individuals eligible

MAY -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the executive law, in relation to ensuring that color vision requirements for appointment of police officers are tailored to only eliminate individuals with extreme color vision deficiencies from eligibility THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 840 of the executive law is amended by adding a new subdivision 2-c to read as follows: 2-C. RULES AND/OR REGULATIONS PROMULGATED PURSUANT TO SUBDIVISION TWO OF THIS SECTION RELATING TO COLOR VISION REQUIREMENTS FOR INDIVIDUALS ELIGIBLE FOR APPOINTMENT AS POLICE OFFICERS SHALL BE TAILORED TO ONLY ELIMINATE INDIVIDUALS WITH EXTREME COLOR VISION DEFICIENCIES FROM SUCH ELIGIBILITY. A POLICE OFFICER OR APPLICANT WHO FAILS TO MEET AN INITIAL COLOR VISION STANDARD SHALL BE DEEMED TO MEET SUCH STANDARD UPON DEMON- STRATING THAT THEY CAN CORRECTLY DISCRIMINATE COLORS VIA A FIELD TEST APPROVED BY THE COUNCIL AND CONDUCTED BY THE COUNTY, CITY, TOWN, VILLAGE OR POLICE DISTRICT. FOR THE PURPOSES OF THIS SUBDIVISION, THE TERM "EXTREME COLOR VISION DEFICIENCIES" SHALL MEAN EXTREME ANOMALOUS TRICH- ROMATISM OR MONOCHROMACY COLOR VISION, AS DETERMINED THROUGH TESTING APPROVED BY THE COUNCIL, WHICH MAY INCLUDE A FARNSWORTH DICHOTOMOUS D-15 TEST OR ANY OTHER TEST DESIGNED AND DOCUMENTED TO IDENTIFY EXTREME ANOM- ALOUS TRICHROMATIC, DICHROMATIC OR MONOCHROMATIC COLOR VISION. § 2.
