BILL NUMBER: S4419 SPONSOR: MAY TITLE OF BILL: An act to amend the judiciary law, in relation to requiring the office of court administration to establish a searchable public database providing information regarding eviction proceedings in the state PURPOSE: To establish a searchable database providing information regarding eviction proceedings in the state. SUMMARY OF PROVISIONS: Section 1 requires the Office of Court Administration to establish an electronic database of all eviction proceedings in the state. The data- base shall include, but is not limited to, the following: the docket number and the date the action was filed, whether the tenant had legal representation, whether an eviction has been ordered and on what date was it ordered, the reason for the eviction and nonpayment amount owed

MAY -- read twice and ordered printed, and when printed to be committed to the Committee on Judiciary AN ACT to amend the judiciary law, in relation to requiring the office of court administration to establish a searchable public database providing information regarding eviction proceedings in the state THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 2 of section 212 of the judiciary law is amended by adding a new paragraph (ff) to read as follows: (FF) ESTABLISH AN ELECTRONIC DATABASE OF ALL EVICTION PROCEEDINGS IN THE STATE. SUCH DATABASE SHALL INCLUDE, BUT NOT BE LIMITED TO, THE FOLLOWING: THE DOCKET NUMBER AND DATE THE ACTION WAS FILED; WHETHER THE TENANT HAD LEGAL REPRESENTATION IN THE EVICTION PROCEEDING; WHETHER AN EVICTION HAS BEEN ORDERED AND THE DATE ON WHICH SUCH EVICTION WAS ORDERED; THE REASON FOR THE EVICTION AND, WHERE THE REASON IS FOR NONPAYMENT, THE AMOUNT OWED; WHETHER THE TENANT HAD A LEASE AGREEMENT; THE NUMBER OF INDIVIDUALS EVICTED AND THE NUMBER OF UNIQUE HOUSEHOLDS; WHETHER THE PROPERTY IS COMMERCIAL OR RESIDENTIAL; AND THE ZIP CODE OF THE PROPERTY. IN COMPLIANCE WITH THE TENANT PROTECTION ACT OF TWO THOU- SAND NINETEEN, ANY PERSONALLY IDENTIFIABLE INFORMATION SHALL NOT BE INCLUDED IN THE DATABASE. SUCH DATABASE SHALL BE AVAILABLE TO THE PUBLIC, ACCESSIBLE FROM THE OFFICE'S WEBSITE, AND ABLE TO BE SEARCHED AND SORTED INTO THE CATEGORIES REQUIRED TO BE INCLUDED IN THE DATABASE PURSUANT TO THIS PARAGRAPH. THE CHIEF ADMINISTRATOR SHALL ADOPT RULES CONSISTENT WITH THE REQUIREMENTS OF THIS PARAGRAPH DIRECTING ANY VILLAGE, TOWN OR OTHER LOCAL COURTS THAT MAY HAVE EVICTION PROCEEDINGS WITHIN THEIR SUBJECT MATTER JURISDICTION TO REPORT THEIR EVICTION PROCEEDING DATA TO THE OFFICE OF COURT ADMINISTRATION NO LESS THAN FOUR TIMES ANNUALLY, AT AN INTERVAL OF THREE MONTHS, FOR THE PURPOSES OF COMPILING THE STATEWIDE EVICTION DATABASE REQUIRED BY THIS PARAGRAPH. § 2.
