TITLE OF BILL:

An act to amend the public authorities law, in relation to requiring the
metropolitan transportation authority to publish certain information
pertaining to capital project data for projects that are committed for
construction on the capital program dashboard

 
PURPOSE:

Requires the metropolitan transit authority to include additional infor-
mation regarding capital projects on the "Capital Program Dashboard" on
the authority's website.

 
SUMMARY OF PROVISIONS:

Section 1 amends section 1269-b of the public authorities law to add the
following new requirements for the NITA's Capital Program Dashboard for
each project: a listing of all contract numbers, vendors, and contrac-
tors; all sources of funding for the project; and coding regarding

whether the project is related to accessibility or resiliency. Section I
also provides definitions for fund sources, accessibility, and resilien-
cy for purposes of the legislation and clarifies plain language require-
ments for the dashboard.

 
JUSTIFICATION:

While there have been increased efforts by the NITA to expand transpar-
ency on how they are allocating funds in their operating and capital
budgets, it is still not enough. The VITA. provides a wealth of informa-
tion on capital projects, contractors, and spending. but it is scattered
through dozens of documents (often PDFs), making it difficult for the
public to connect the dots to see for themselves how their taxpayer and
fare dollars are being spent. The capital dashboard is currently the
MIA's central repository for capital project information; and can be
improved with more complete data about projects, including their
finances.

Our legislation mandates that the NITA post a listing of all contract
numbers, vendors, and contractors associated with the project, all
sources of funding for projects, and coding regarding whether the
project is related to accessibility or sustainability. in addition:  in
the bill accessibility projects are specified as regarding elevators,
escalators, or compliance with the Americans with Disabilities Act,
resiliency is defined by the NIT in its twenty-year needs assessments
and definitions must be provided in the data dictionary.

 AN ACT to amend the public authorities law, in relation to requiring the
   metropolitan  transportation  authority to publish certain information
   pertaining to capital project data for projects that are committed for
   construction on the capital program dashboard
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subparagraphs (vii) and (viii) of paragraph (d) of subdivi-
 sion  2-a  of  section 1269-b of the public authorities law, as added by
 section 1 of part LLL of chapter 58 of the laws of 2022, are amended and
 three new subparagraphs (ix), (x), (xi) and  an  undesignated  paragraph
 are added to read as follows:
   (vii)  budget information including the original budget at the time of
 project commitment when scope and budget are  defined,  all  amendments,
 the current budget and planned annual allocations; [and]
   (viii) a schedule for project delivery including original, amended and
 current start and completion dates as projects develop at each phase[.];
   (IX) A LISTING OF ALL CONTRACT NUMBERS, VENDORS, AND CONTRACTORS ASSO-
 CIATED WITH THE PROJECT;
   (X) ALL SOURCES OF FUNDING FOR THE PROJECT; AND
   (XI)  CODING REGARDING WHETHER THE PROJECT IS RELATED TO ACCESSIBILITY
 OR RESILIENCY.
   FOR THE PURPOSES OF THIS PARAGRAPH, SOURCES OF FUNDING SHALL BE SPECI-
 FIED AS FROM THE STATE OF NEW YORK, THE FEDERAL GOVERNMENT, THE CITY  OF
 NEW  YORK,  OR  ANY OTHER RELEVANT SOURCE. FUNDING FROM THE STATE OF NEW
 YORK SHALL FURTHER SPECIFY WHETHER IT HAS BEEN OBTAINED FROM THE CENTRAL
 BUSINESS DISTRICT TOLLING LOCKBOX AS ESTABLISHED BY SECTION FIVE HUNDRED
 FIFTY-THREE-J OF THIS CHAPTER OR ANY SUCCESSOR FUND OR ACCOUNT  PROVIDED
 BY  LAW.  ACCESSIBILITY SHALL MEAN PROJECTS REGARDING ELEVATORS, ESCALA-
 
  EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                       [ ] is old law to be omitted.

 TORS OR OTHER PROJECTS RELATED TO COMPLIANCE WITH THE FEDERAL  AMERICANS
 WITH DISABILITIES ACT OF 1990, AS AMENDED, AND CORRESPONDING GUIDELINES.
 RESILIENCY  SHALL  HAVE  THE SAME MEANING AS DEFINED BY THE AUTHORITY IN
 ITS  TWENTY-YEAR  NEEDS ASSESSMENT RELEASED IN TWO THOUSAND TWENTY-THREE
 AS REQUIRED BY SUBDIVISION C OF SECTION TWELVE HUNDRED  SIXTY-NINE-C  OF
 THIS TITLE.
   § 2. This act shall take effect immediately.
