 Introduced  by  Sen.  STEC  --  read twice and ordered printed, and when
   printed to be committed to the Committee on Crime Victims,  Crime  and

 AN  ACT  to  amend the correction law, in relation establishing a third-
   party vendor program to send certain packages to incarcerated individ-
   uals

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Section  112 of the correction law is amended by adding a
 new subdivision 7 to read as follows:
   7. (A) THE COMMISSIONER SHALL ESTABLISH A  THIRD-PARTY  SECURE  VENDOR
 MAIL PROGRAM OF NOT MORE THAN TEN VENDORS, TO BE UTILIZED FOR THE DELIV-
 ERY OF ALL PACKAGES AND ARTICLES TO INCARCERATED INDIVIDUALS, INCLUDING,
 BUT NOT LIMITED TO THE ORDER AND DELIVERY OF ALL PRODUCTS TO INCARCERAT-
 ED INDIVIDUALS HOUSED AT CORRECTIONAL FACILITIES.
   (B) THE COMMISSIONER SHALL PROMULGATE ANY RULES AND REGULATIONS NECES-
 SARY  TO  IMPLEMENT  THE PROVISIONS OF THIS SUBDIVISION. ANY REGULATIONS
 SHALL REQUIRE THAT ALL PACKAGES AND ARTICLES ARE SENT  VIA  AN  APPROVED
 THIRD-PARTY  SECURE VENDOR. SUCH REQUIREMENT SHALL NOT APPLY TO LETTERS,
 CARDS OR OTHER ITEMS THAT ARE SHIPPED VIA UNITED STATES  POSTAL  SERVICE
 FIRST-CLASS MAIL.
   § 2. This act shall take effect immediately.
