BILL NUMBER: S4646 SPONSOR: COONEY TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to suspending the registration of vehicles which have been documented multiple times by a photo speed violation monitoring system for speeding in a highway construction or maintenance work area PURPOSE: To further discourage speeding and reckless behavior in work zones by suspending the registration of repeat violators. SUMMARY OF PROVISIONS: Section one adds a new paragraph to subdivision (e) of section 1180-e of the vehicle and traffic law to suspend, for ninety days, the registra- tion of a vehicle cited four or more times by a work zone speed camera. Section two sets the effective date.

COONEY -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to suspending the registration of vehicles which have been documented multiple times by a photo speed violation monitoring system for speeding in a highway construction or maintenance work area THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision (e) of section 1180-e of the vehicle and traf- fic law, as added by chapter 421 of the laws of 2021, is amended to read as follows: (e) 1. An owner liable for a violation of subdivision (b), (d), (f) or (g) of section eleven hundred eighty of this article pursuant to a demonstration program established pursuant to this section shall be liable for monetary penalties not to exceed fifty dollars for a first violation, seventy-five dollars for a second violation both of which were committed within a period of eighteen months, and one hundred dollars for a third or subsequent violation all of which were committed within a period of eighteen months; provided, however, that an addi- tional penalty not in excess of twenty-five dollars for each violation may be imposed for the failure to respond to a notice of liability with- in the prescribed time period. 2. (I) THE REGISTRATION OF A VEHICLE WHICH HAS BEEN DOCUMENTED FOUR OR MORE TIMES WITHIN AN EIGHTEEN-MONTH PERIOD FOR A VIOLATION OF SUBDIVI- SION (B), (D), (F) OR (G) OF SECTION ELEVEN HUNDRED EIGHTY OF THIS ARTI- CLE PURSUANT TO A DEMONSTRATION PROGRAM ESTABLISHED PURSUANT TO THIS SECTION SHALL BE SUSPENDED FOR A PERIOD OF NINETY DAYS FOR EACH VIOLATION BEYOND THE THIRD THAT OCCURS WITHIN SUCH EIGHTEEN-MONTH PERI- OD. SUCH PERIOD OF SUSPENSION SHALL COMMENCE TEN DAYS AFTER THE NOTICE OF LIABILITY FOR THE FOURTH OR SUBSEQUENT VIOLATION HAS BEEN MAILED.
