BILL NUMBER: S4997 SPONSOR: HARCKHAM TITLE OF BILL: An act to amend the public health law, in relation to prohibiting nurs- ing homes and care facilities from denying admission to individuals receiving a controlled substance medication for a substance use disorder PURPOSE: Prohibits nursing homes and care facilities from denying admission to individuals using a controlled substance medication for substance use disorder (SUD). SUMMARY OF PROVISIONS: Section 1 amends the public health law to provide that no nursing home or medical facility is allowed to deny an individual admission to their facility because they are receiving a controlled substance medication for substance use disorder.

HARCKHAM -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to prohibiting nurs- ing homes and care facilities from denying admission to individuals receiving a controlled substance medication for a substance use disor- der THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 3 of section 2803-c of the public health law is amended by adding a new paragraph s to read as follows: S. NO NURSING HOME OR FACILITY PROVIDING HEALTH RELATED SERVICES, WHICH IS REGISTERED WITH THE STATE OF NEW YORK AND REGISTERED WITH THE FEDERAL DRUG ENFORCEMENT AGENCY, THAT MAINTAINS A STOCK OF, AND DIRECTLY DISPENSES, CONTROLLED SUBSTANCE MEDICATIONS, AS DEFINED IN SECTION THIR- TY-THREE HUNDRED SIX OF THIS CHAPTER, SHALL DENY ADMISSION TO AN INDI- VIDUAL WHO IS RECEIVING A CONTROLLED SUBSTANCE MEDICATION FOR A SUBSTANCE USE DISORDER. § 2.
