BILL NUMBER: S5254 SPONSOR: RYAN C TITLE OF BILL: An act to amend the labor law, in relation to protecting certain employ- ees from a reduction of wages due to their involvement in the investi- gation of a violation of a workplace violence protection program PURPOSE OR GENERAL IDEA OF BILL: To ensure public sector employees participating in a mandated workplace violence inspection, risk evaluation and determination inspection, or an annual program review are entitled to do so without the loss of wages. SUMMARY OF PROVISIONS: Section 1 amends section 27-b of the Labor Law to explicitly authorize employees to accompany the commissioner of labor during a workplace violence inspection, participate in a risk evaluation and determination inspection, and an annual program review without a reduction in wages.

RYAN -- read twice and ordered printed, and when printed to be committed to the Committee on Labor AN ACT to amend the labor law, in relation to protecting certain employ- ees from a reduction of wages due to their involvement in the investi- gation of a violation of a workplace violence protection program THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 6 of section 27-b of the labor law is amended by adding a new paragraph d-1 to read as follows: D-1. NO EMPLOYEE WHO ACCOMPANIES THE COMMISSIONER ON AN INSPECTION, PARTICIPATES IN A RISK EVALUATION AND DETERMINATION INSPECTION, OR PARTICIPATES IN AN ANNUAL PROGRAM REVIEW SHALL SUFFER ANY REDUCTION IN WAGES. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD07268-01-5
