2025-S5385 (ACTIVE) - Summary

Permits the commissioner of motor vehicles to require any licensed driver to submit to an examination or reexamination prior to such licensed driver's normal renewal date upon receipt of a recommendation from a court having jurisdiction of traffic offenses, or the governor or chief magistrate of a state or territory stating that the driver's ability to operate a motor vehicle safely is questionable.

 Introduced  by Sens. HARCKHAM, HINCHEY, MAYER, SKOUFIS -- read twice and
   ordered printed, and when printed to be committed to the Committee  on
   Transportation
 
 AN  ACT  to amend the vehicle and traffic law, in relation to reexamina-
   tion of licensees
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Section  506 of the vehicle and traffic law is amended by
 adding a new subdivision 6 to read as follows:
   6. THE COMMISSIONER MAY REQUIRE ANY LICENSED DRIVER TO  SUBMIT  TO  AN
 EXAMINATION  OR  REEXAMINATION  PRIOR  TO  SUCH LICENSED DRIVER'S NORMAL
 RENEWAL DATE UPON RECEIPT OF A RECOMMENDATION FROM A COURT HAVING JURIS-
 DICTION OF TRAFFIC OFFENSES, OR THE GOVERNOR OR CHIEF  MAGISTRATE  OF  A
 STATE  OR TERRITORY STATING THAT THE DRIVER'S ABILITY TO OPERATE A MOTOR
 VEHICLE SAFELY IS QUESTIONABLE.  IN  REVIEWING  SUCH  LICENSED  DRIVER'S
 QUALIFICATIONS  TO  OPERATE A MOTOR VEHICLE, THE COMMISSIONER SHALL ONLY
 CONSIDER THE PREVIOUS TEN YEARS OF THE LICENSED DRIVER'S DRIVING RECORD.
   § 2. This act shall take effect immediately.
