SANDERS, STAVISKY -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to the definition of consent THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 10.00 of the penal law is amended by adding a new subdivision 23 to read as follows: 23. "CONSENT" MEANS A FREELY GIVEN, KNOWLEDGEABLE AND INFORMED AGREE- MENT BY A PERSON WITH THE CAPACITY TO REASON. § 2. This act shall take effect on the ninetieth day after it shall have become a law.
