BILL NUMBER: S5635 SPONSOR: HOYLMAN-SIGAL TITLE OF BILL: An act to amend the social services law, in relation to coverage for iatrogenic fertility preservation services PURPOSE OR GENERAL IDEA OF BILL: To cover fertility preservation services in the case of iatrogenic infertility SUMMARY OF PROVISIONS: Section one: Provides a short title Section two: Adds a new subsection NN to section 365-A of the Social Services Law covering fertility preservation treatments in the case of iatrogenic infertility under Medicaid. Section three: Establishes the effective date.

HOYLMAN-SIGAL -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the social services law, in relation to coverage for iatrogenic fertility preservation services THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. This act shall be known and may be cited as the "fertility protection act". § 2. Subdivision 2 of section 365-a of the social services law is amended by adding a new paragraph (nn) to read as follows: (NN) STANDARD FERTILITY PRESERVATION SERVICES WHEN A MEDICAL TREATMENT MAY DIRECTLY OR INDIRECTLY CAUSE IATROGENIC INFERTILITY TO A RECIPIENT. FOR THE PURPOSES OF THIS PARAGRAPH, "IATROGENIC INFERTILITY" MEANS AN IMPAIRMENT OF FERTILITY BY SURGERY, RADIATION, CHEMOTHERAPY OR OTHER MEDICAL TREATMENT AFFECTING REPRODUCTIVE ORGANS OR PROCESSES. § 3. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD04169-01-5
