BILL NUMBER: S6439 SPONSOR: FAHY TITLE OF BILL: An act in relation to issuing the village of Nelliston incorporation documents PURPOSE OR GENERAL IDEA OF BILL: To establish the Village of Nelliston as an incorporated village in New York State. SUMMARY OF SPECIFIC PROVISIONS: Section 1. Legislative findings. It is hereby found and determined that the village of Nelliston was incorporated in 1878 under the authority granted by Chapter 291 of the Laws of 1870. It is further determined that the village of Nelliston was not required to submit incorporation documents to the Department of State as there was no statutory require- ment for certificates of incorporation to be filed with the Department at that time. FAHY -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT in relation to issuing the village of Nelliston incorporation documents THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Legislative findings. It is hereby found and determined that the village of Nelliston in the town of Palatine, Montgomery coun- ty, was incorporated in 1878 under the authority granted by chapter 291 of the laws of 1870. It is further determined that the village of Nelli- ston was not required to submit incorporation documents to the depart- ment of state as there was no statutory requirement for certificates of incorporation to be filed with the department at that time. It is further determined that the village of Nelliston lost its original incorporation documents in a fire in the late 1800s and no other incor- poration document exists. § 2. The village of Nelliston is to be recognized as incorporated since 1878 under the authority granted by chapter 291 of the laws of 1870. The secretary of state shall issue to the village of Nelliston a certificate of incorporation verifying the status of the village of Nelliston as incorporated as a village since 1878. The reissued certif- icate of incorporation is to be filed and kept by the department of state, as required by section 2-234 of the village law. § 3. This act shall take effect immediately.
