BILL NUMBER: S6665 SPONSOR: HINCHEY TITLE OF BILL: An act to amend the alcoholic beverage control law, in relation to an exemption for certain property from the prohibition of alcohol sales within a certain distance of a church PURPOSE: To provide an exemption from the Alcoholic Beverage Control Law, enabl- ing an establishment within the City of Hudson located within two-hun- dred feet of a church to be eligible to apply for a liquor license from the NYS Liquor Authority. SUMMARY OF PROVISIONS: Section 1: Amends subdivision 7 of Section 64 of the Alcoholic Beverage Control Law by adding a new paragraph (e-17) allowing an establishment within the City of Hudson located within two-hundred feet of a church, synagogue, or other place, of worship to be eligible to apply for a

HINCHEY -- read twice and ordered printed, and when printed to be committed to the Committee on Commerce, Economic Devel- opment and Small Business AN ACT to amend the alcoholic beverage control law, in relation to an exemption for certain property from the prohibition of alcohol sales within a certain distance of a church THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 7 of section 64 of the alcoholic beverage control law is amended by adding a new paragraph (e-17) to read as follows: (E-17) NOTWITHSTANDING THE PROVISIONS OF PARAGRAPH (A) OF THIS SUBDI- VISION, THE AUTHORITY MAY ISSUE A RETAIL LICENSE FOR ON-PREMISES CONSUMPTION FOR A PREMISES WHICH SHALL BE LOCATED WITHIN TWO HUNDRED FEET OF A BUILDING OCCUPIED AS A CHURCH, SYNAGOGUE OR OTHER PLACE OF WORSHIP, PROVIDED SUCH PREMISES CONSTITUTE A PREMISES FOR THE SALE OF FOOD OR BEVERAGES AT RETAIL FOR CONSUMPTION ON THE PREMISES LOCATED WHOLLY WITHIN THE BOUNDARIES OF THE COUNTY OF COLUMBIA, BOUNDED AND DESCRIBED AS FOLLOWS: ALL THAT CERTAIN PIECE OR PARCEL OF LAND SITUATE, LYING AND BEING IN THE CITY OF HUDSON, COUNTY OF COLUMBIA AND THE STATE OF NEW YORK, MORE PARTICULARLY BOUNDED AND DESCRIBED AS FOLLOWS: BEGINNING AT A POINT FORMED BY THE INTERSECTION ON THE PRESUMED NORTHEASTERLY LINE OF WARREN STREET WITH THE PRESUMED SOUTHEASTERLY LINE OF FOURTH STREET AT OR NEAR THE CORNER OF THE BRICK BUILDING ON THIS PROPERTY; THENCE RUNNING NORTH 44 DEGREES, 15 MINUTES AND 30 SECONDS EAST FOR A DISTANCE OF 77.65 FEET AND NORTH 44 DEGREES, 15 MINUTES AND 30 SECONDS EAST FOR A DISTANCE OF 42.35 FEET TO THE PRESUMED SOUTHWES- TERLY LINE OF PRISON ALLEY; THENCE RUNNING SOUTH 45 DEGREES, 44 MINUTES AND 30 SECONDS EAST FOR A DISTANCE OF 20.29 FEET, SOUTH 45 DEGREES, 44 MINUTES AND 30 SECONDS EAST FOR A DISTANCE OF 29.71 FEET, AND SOUTH 45 EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
