BILL NUMBER: S6689 SPONSOR: GALLIVAN TITLE OF BILL: An act to amend the social services law, in relation to extending the time where certain entities can provide fiscal intermediary services PURPOSE OF BILL: Extends the transition period of the Consumer Directed Personal Assist- ance Program (CDPAP) to a single fiscal intermediary from April 1st to July 1st, 2025 in order to provide the necessary time for consumers and personal assistants alike to complete the registration process with the State's designated fiscal intermediary. SUMMARY OF PROVISIONS: Section one amends the provision of the social services law governing fiscal intermediary registration related to the Consumer Directed Personal Assistance Program to July 1st, 2025 from April 1st, 2025.

GALLIVAN -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the social services law, in relation to extending the time where certain entities can provide fiscal intermediary services THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 4-a-1 of section 365-f of the social services law, as added by section 3 of part HH of chapter 57 of the laws of 2024, is amended to read as follows: 4-a-1. FISCAL INTERMEDIARY REGISTRATION. (a) [Fiscal intermediary registration.] Except for the statewide fiscal intermediary and its subcontractors, as of [April] JULY first, two thousand twenty-five, no entity shall provide, directly or through contract, fiscal intermediary services. All subcontractors of the statewide fiscal intermediary, shall register with the department within thirty days of being selected as a subcontractor. (b) In selecting its subcontractors, the statewide fiscal intermediary shall consider demonstrated compliance with all applicable federal and state laws and regulations, including but not limited to, marketing and labor practices, cost reporting, and electronic visit verification requirements. § 2. This act shall take effect immediately and shall be deemed to have been in full force and effect on and after April 1, 2025.
