BILL NUMBER: S6734 SPONSOR: FAHY TITLE OF BILL: An act to amend the education law, in relation to providing that elections to fill an increased number of seats on a school board will be conducted at the annual meeting after the number of seats was increased PURPOSE: Following an increase in the number of board members after an annual meeting, this legislation allows school boards to conduct the election to fill the new seat within a year, as opposed to the more restrictive current deadline of between thirty and sixty days after an election. SUMMARY OF PROVISIONS: Section 1 amends section 1703 of the education law to provide that elections to fill new board vacancies created by increasing the number of members on the board shall be held at the annual meeting following the annual meeting where the number of members was increased.

FAHY -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to providing that elections to fill an increased number of seats on a school board will be conducted at the annual meeting after the number of seats was increased THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 3 of section 1703 of the education law, as amended by chapter 797 of the laws of 1957, is amended to read as follows: 3. The additional members first elected shall be elected at [a special meeting which shall be called by the board and be held not less than thirty nor more than sixty days] THE ANNUAL MEETING NEXT following the annual meeting at which the number was increased, and pending the first election of such additional members no vacancy shall be deemed to exist in the offices thereof except for the purpose of filling the same by election, notwithstanding any inconsistent provision of any law. § 2.
