BILL NUMBER: S6746 SPONSOR: FELDER TITLE OF BILL: An act to amend the penal law, in relation to unlawful concealment of identity during a protest PURPOSE: To prevent the anonymity of individuals who commit aggressive actions or crimes during a protest. SUMMARY OF PROVISIONS: Section one of the bill adds section 240.11 to the penal law estab- lishing the crime of concealment of identity during a protest when such person, while involved in a lawful assembly, unlawful assembly, protest or riot, wears a mask or facial covering to conceal their identity. It also creates several exemptions. Section two of the bill provides the effective date.

FELDER -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to unlawful concealment of identity during a protest THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The penal law is amended by adding a new section 240.11 to read as follows: § 240.11 CONCEALMENT OF IDENTITY DURING A PROTEST. A PERSON IS GUILTY OF CONCEALMENT OF IDENTITY DURING A PROTEST WHEN SUCH PERSON, WHILE INVOLVED IN A LAWFUL ASSEMBLY, UNLAWFUL ASSEMBLY, PROTEST, OR RIOT, WEARS A MASK OR FACIAL COVERING WHEREBY THE PERSON OR THE PERSON'S FACE IS DISGUISED SO AS TO CONCEAL THE IDENTITY OF THE WEARER. THIS SECTION SHALL NOT APPLY TO ANY PERSON WEARING: 1. A MASK, HOOD, OR ANY DEVICE FOR PROTECTION FROM WEATHER; 2. HEAD COVERINGS OR VEILS IN ACCORDANCE WITH RELIGIOUS OBSERVANCE OR CUSTOMS; 3. A MASK FOR MEDICAL PURPOSES; OR 4. A COSTUME IN ANY PUBLIC PARADE, HOLIDAY, OR EXHIBITION OF AN EDUCA- TIONAL, RELIGIOUS, OR HISTORICAL CHARACTER. CONCEALMENT OF IDENTITY DURING A PROTEST IS A VIOLATION. § 2. This act shall take effect immediately.
