TITLE OF BILL:

An act to amend the alcoholic beverage control law, in relation to
providing the village of Ossining, Westchester county, with the ability
to set restrictions on the hours of sale of alcoholic beverages at
retail for on-premises consumption

 
PURPOSE:

Provides the village of Ossining, Westchester county, with an exemption
from restrictions on the hours of sale of alcoholic beverages at retail
for on-premises consumption

 
SUMMARY OF PROVISIONS:

Section 1 amends subdivision 5-a of section 106 of the alcoholic bever-
age control law to provide an exemption to the village of Ossining to
decide when to close places that serve alcoholic beverages for on-prem-
ises consumption.

Section 2 states the effective date.

 
JUSTIFICATION:

The village of Ossining currently has bars and taverns that remain open
until 4 A.M. Many residents have voiced their concerns involving intoxi-
cated individuals causing damage to property, driving while intoxicated,
and suffering injury past 2 A.M. due to certain establishments remaining
open. This has caused an increase in the deployment of medical and law
enforcement resources to the areas surrounding these establishments.
Allowing the village of Ossining to set bar and tavern closing times
would reduce the destruction of property and would eliminate the emer-
gency calls related to incidents of intoxication. This legislation comes
at the request of the village of Ossining

EFFECTIVE DATE:
This act shall take effect on the thirtieth day after it shall have

 AN ACT to amend the alcoholic  beverage  control  law,  in  relation  to
   providing the village of Ossining, Westchester county, with the abili-
   ty  to set restrictions on the hours of sale of alcoholic beverages at
   retail for on-premises consumption
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Section  106  of  the  alcoholic  beverage control law is
 amended by adding a new subdivision 5-a to read as follows:
   5-A. NOTWITHSTANDING ANY PROVISION OF LAW, RULE OR REGULATION  TO  THE
 CONTRARY,  THE  PROVISIONS OF SUBDIVISION FIVE OF THIS SECTION SHALL NOT
 BE CONSTRUED TO PROHIBIT THE VILLAGE OF  OSSINING,  WESTCHESTER  COUNTY,
 FROM IMPOSING RESTRICTIONS ON THE HOURS ALCOHOLIC BEVERAGES MAY BE SOLD,
 OFFERED  FOR SALE OR GIVEN AWAY UPON ANY PREMISES LICENSED TO SELL ALCO-
 HOLIC BEVERAGES AT RETAIL FOR  ON-PREMISES  CONSUMPTION  BY  LOCAL  LAW,
 ORDINANCE,  OR RESOLUTION WHICH ARE MORE RESTRICTIVE THAN THE PROVISIONS
 SET FORTH IN SUCH SUBDIVISION.
   § 2. This act shall take effect on the thirtieth day  after  it  shall
 have become a law.
