BILL NUMBER: S7028 SPONSOR: WALCZYK TITLE OF BILL: An act in relation to authorizing the city of Little Falls, in the coun- ty of Herkimer, to finance certain deficits by the issuance of bonds PURPOSE OR GENERAL IDEA OF BILL: This bill authorizes the city of Little Falls to finance deficits via bonds. SUMMARY OF PROVISIONS: Section 1: Names the bill. Section 2: Authorizes the city of Little Falls to issue up to $3.4 million in serial bonds on or before October 1, 2026. Section 3: Establishes that the Comptroller must review the necessity of bonds prior to their issuance. The bill also requires the city to submit a report to the chairs of the Senate Finance Committee and Assembly Ways and Means Committee.

WALCZYK -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT in relation to authorizing the city of Little Falls, in the coun- ty of Herkimer, to finance certain deficits by the issuance of bonds THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Short title. This act shall be known and may be cited as the "city of Little Falls fiscal recovery act". § 2. The city of Little Falls, county of Herkimer, is hereby author- ized to issue serial bonds, subject to the provisions of section 10.10 of the local finance law, on or before October 1, 2026, in an aggregate principal amount not to exceed three million four hundred thousand dollars ($3,400,000) for the specific object or purpose of liquidating deficits in its general, golf, and water funds expected at the close of its fiscal year ending December 31, 2025, including any remaining prin- cipal amount of any budget, deficiency, and/or revenue anticipation notes outstanding at the time of such issuance of such serial bonds or notes authorized pursuant to this act. In anticipation of the issuance and sale of such serial bonds, bond anticipation notes are hereby authorized to be issued. § 3. Notwithstanding any provision of this act to the contrary, the city of Little Falls shall not issue any bonds for the purpose of liqui- dating the deficits described in section two of this act unless and until the state comptroller shall first review and confirm the existence of such deficits, as well as certify the amounts of such deficits. The city of Little Falls shall prepare a report detailing the amount and cause of such deficits and submit such report together with such city's independent audit report for its last completed fiscal year, if any such audit report has been or is to be prepared, and such other information as the state comptroller may deem necessary, to the state comptroller, as well as the chairs of the senate finance committee and the assembly EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
