BILL NUMBER: S7071 SPONSOR: WEBB TITLE OF BILL: An act to amend the public health law, in relation to domestic violence training for health and mental health professionals PURPOSE OR GENERAL IDEA OF BILL: The intent of this act is to implement training amongst health and mental health professionals in cooperation with the Office for the Prevention of Domestic Violence in order to better facilitate care for domestic violence 'survivors. SUMMARY OF PROVISIONS: Section 1 amends section 206 of the public health law by adding a new subdivision 33. Subdivision 33(a) directs the Commissioner of Health to create mandatory trainings for health and mental health professionals in cooperation with the Office for the Prevention of Domestic Violence, that such trainings are to be reviewed and updated on an annual basis,

WEBB -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to domestic violence training for health and mental health professionals THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 206 of the public health law is amended by adding a new subdivision 33 to read as follows: 33. (A) THE COMMISSIONER SHALL PROMULGATE RULES AND REGULATIONS WHICH SHALL ENSURE THAT TRAININGS ON PROVIDING CARE FOR VICTIMS OF DOMESTIC VIOLENCE ARE DEVELOPED AND DELIVERED TO HEALTH AND MENTAL HEALTH PROFES- SIONALS. SUCH TRAININGS SHALL BE REVIEWED AND UPDATED ANNUALLY IN CONSULTATION WITH THE OFFICE FOR THE PREVENTION OF DOMESTIC VIOLENCE. SUCH TRAININGS SHALL INCLUDE INSTRUCTION THAT HEALTH AND MENTAL HEALTH PROFESSIONALS ARE NOT SUBJECT TO MANDATORY REPORTING FOR INSTANCES OF DOMESTIC VIOLENCE AGAINST ADULTS. (B) THE COMMISSIONER SHALL CONVENE A TASK FORCE RESPONSIBLE FOR ENSUR- ING THAT ALL HEALTH AND MENTAL HEALTH PROFESSIONALS IN THE STATE RECEIVE THE TRAININGS UNDER PARAGRAPH (A) OF THIS SUBDIVISION ON AN ANNUAL BASIS. SUCH TASK FORCE SHALL COLLECT DATA ON THE PARTICIPATION OF SUCH TRAININGS BY HEALTH AND MENTAL HEALTH PROFESSIONALS IN THE STATE. § 2. This act shall take effect immediately.
