BILL NUMBER: S7072 SPONSOR: WEBB TITLE OF BILL: An act to amend the general municipal law, in relation to expanding the Tompkins county industrial development agency from seven to nine members PURPOSE: The purpose of this legislation is to authorize the expansion of the Tompkins County Industrial Development Agency (TCIDA) from seven to nine members. JUSTIFICATION: The Tompkins County Legislature has requested home rule legislation which would authorize them to expand the Tompkins County Industrial Development Agency (TCIDA) from seven to nine members. The county would like to increase its membership as more members would enhance its abili- ty to represent diverse perspectives and expertise. A member from a school district within Tompkins County on the TCIDA would help ensure

WEBB -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the general municipal law, in relation to expanding the Tompkins county industrial development agency from seven to nine members THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 895-b of the general municipal law, as added by chapter 535 of the laws of 1971, is amended to read as follows: § 895-b. Tompkins county industrial development agency. For the bene- fit of the county of Tompkins and the inhabitants thereof, an industrial development agency, to be known as the TOMPKINS COUNTY INDUSTRIAL DEVEL- OPMENT AGENCY, is hereby established for the accomplishment of any or all of the purposes specified in title one of article eighteen-A of this chapter. It shall constitute a body corporate and politic, and be perpetual in duration. It shall have the powers and duties now or here- after conferred by title one of article eighteen-A of this chapter upon industrial development agencies and, provided however, that the exercise of the powers by such agency with respect to the acquisition of real property whether by purchase, condemnation or otherwise, shall be subject to the local zoning and planning regulations and shall take into consideration the regional and local comprehensive land use plans. It shall be organized in a manner prescribed by and be subject to the provisions of title one of article eighteen-A of this chapter. Its members shall be appointed by the governing body of the county of Tomp- kins. The agency, its members, officers and employees and its operations and activities shall in all respects be governed by the provisions of title one of article eighteen-A of this chapter PROVIDED, HOWEVER, THAT NOTWITHSTANDING THE PROVISIONS OF SUBDIVISION TWO OF SECTION EIGHT HUNDRED FIFTY-SIX OF THIS CHAPTER REQUIRING A MUNICIPAL INDUSTRIAL DEVELOPMENT AGENCY TO CONSIST OF NO MORE THAN SEVEN MEMBERS, THE TOMP- KINS COUNTY LEGISLATURE IS HEREBY AUTHORIZED TO APPOINT NINE MEMBERS TO THE COUNTY OF TOMPKINS INDUSTRIAL DEVELOPMENT AGENCY. § 2. This act shall take effect immediately.
