BILL NUMBER: S7236 SPONSOR: GIANARIS TITLE OF BILL: An act to amend the penal law, in relation to restrictions on the receipt of ammunition PURPOSE: To amend the penal law to require ammunition background checks to be denied if the prospective purchaser cannot lawfully possess a rifle or shotgun under federal or New York State law. SUMMARY OF PROVISIONS: Section one of this bill would amend Penal Law § 400.03 to require ammu- nition background checks to be denied if the prospective purchaser cannot lawfully possess a rifle or shotgun under federal or New York State law. Section two sets the effective date, which is immediately upon signing.

GIANARIS -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to restrictions on the receipt of ammunition THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 400.03 of the penal law is amended by adding a new subdivision 9 to read as follows: 9. ANY AMMUNITION BACKGROUND CHECK REQUIRED UNDER THIS SECTION SHALL BE DENIED IF IT IS DETERMINED THAT THE AMMUNITION PURCHASER IS PROHIBIT- ED FROM POSSESSING A SHOTGUN OR RIFLE PURSUANT TO THIS CHAPTER, SUBSECTION (G) OF SECTION 922 OF TITLE 18 OF THE UNITED STATES CODE, OR A TEMPORARY OR FINAL EXTREME RISK PROTECTION ORDER ISSUED UNDER ARTICLE SIXTY-THREE-A OF THE CIVIL PRACTICE LAW AND RULES. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD11499-01-5
