BILL NUMBER: S7409 SPONSOR: FAHY TITLE OF BILL: An act to amend chapter 670 of the laws of 2024 relating to authorizing the lease of certain lands for the Albany NanoTech Complex, in relation to prohibiting the state university of New York from contracting out certain services PURPOSE OR GENERAL IDEA OF BILL: To ensure that the lease of certain lands at SUNY Albany does not displace any state employees or waive or impair any state employee rights or benefits. SUMMARY OF PROVISIONS: Section one would provide that neither SUNY nor an entity affiliated or associated with SUNY shall contract out to the Fuller Road Management Corporation, subsidiary of such corporation, or the SUNY Research Foun- dation for services or privatize any services currently performed by

FAHY -- read twice and ordered printed, and when printed to be committed to the Committee on Higher Education AN ACT to amend chapter 670 of the laws of 2024 relating to authorizing the lease of certain lands for the Albany NanoTech Complex, in relation to prohibiting the state university of New York from contracting out certain services THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Chapter 670 of the laws of 2024 relating to authorizing the lease of certain lands for the Albany NanoTech Complex, is amended by adding a new section 5-a to read as follows: § 5-A. 1. THE PROVISIONS OF THIS SECTION SHALL ONLY APPLY TO EMPLOYEES IN THE UNCLASSIFIED SERVICE AT THE STATE UNIVERSITY OF NEW YORK. 2. NOTWITHSTANDING ANY LAW, RULE OR REGULATION TO THE CONTRARY, THE STATE UNIVERSITY OF NEW YORK OR AN AFFILIATED OR ASSOCIATED ENTITY OF THE STATE UNIVERSITY OF NEW YORK SHALL NOT CONTRACT OUT TO THE GROUND LESSEE OR ANY SUBSIDIARY OF THE GROUND LESSEE OR THE RESEARCH FOUNDATION FOR THE STATE UNIVERSITY OF NEW YORK FOR ANY SERVICES OR PRIVATIZE ANY SERVICES CURRENTLY BEING PERFORMED BY EMPLOYEES IN THE UNCLASSIFIED SERVICE AT THE STATE UNIVERSITY OF NEW YORK AT ALBANY. ALL SUCH FUNC- TIONS AND SERVICES CURRENTLY PERFORMED BY EMPLOYEES IN UNCLASSIFIED SERVICE SHALL BE PERFORMED BY EMPLOYEES IN THE UNCLASSIFIED SERVICE. 3. NOTHING IN THIS ACT RELATING TO THE LEASE OF PROPERTY TO PRIVATE ENTITIES FOR THE DEVELOPMENT, CONSTRUCTION, OR OPERATION OF FACILITIES SHALL BE DEEMED TO WAIVE OR IMPAIR ANY RIGHTS OR BENEFITS OF EMPLOYEES OF THE STATE UNIVERSITY OF NEW YORK THAT OTHERWISE WOULD BE AVAILABLE TO THEM PURSUANT TO THE TERMS OF AGREEMENTS BETWEEN THE CERTIFIED REPRESEN- TATIVES OF SUCH EMPLOYEES AND THE STATE OF NEW YORK OR PROVISIONS OF ARTICLE FOURTEEN OF THE CIVIL SERVICE LAW. SUNY AND THE STATE OF NEW YORK ACKNOWLEDGE THEIR OBLIGATIONS AS AN EMPLOYER AND AGREE THAT THEY WILL NOT EXERCISE THEIR RIGHT TO CONTRACT OUT FOR SERVICES UNDER ANY APPLICABLE COLLECTIVE BARGAINING AGREEMENT. § 2.
