TITLE OF BILL:

An act to amend the parks, recreation and historic preservation law, in
relation to directing the state commissioner of parks, recreation and
historic preservation to create a process to approve or deny certain new
large urban telecommunication infrastructure

 
PURPOSE:

In urban historic districts throughout New York State, new telecommuni-
cation structures are being unveiled that are significantly out of char-
acter with the neighborhoods in which they are located. This bill would
ensure another layer of review for additional placement of new large
urban telecommunication infrastructure.

 
SUMMARY OF SPECIFIC PROVISIONS:

Section 1 creates a definition of large urban telecommunication infras-
tructure

Section 1 amends the parks, recreation and historic preservation law to
define large urban telecommunication infrastructure. It also asks the
Commissioner of the State Historic Preservation Office to review any new
proposed large urban telecommunication infrastructure that is near a
site eligible to be listed on the state or national register as long as
such review is not preempted by section 106 of the NHPA of 1966.

Section 2 provides the effective date

 
JUSTIFICATION:

Recently in New York City 5G towers have been placed on sidewalks by
companies with complete disregard for the streetscape. These towers
would negatively impact the historic character of New York's carefully
protected historic districts. The towers are too big, compete with the
look of small-scale historic buildings, and take up too much room on
narrow sidewalks. While it is important for New York to build telecommu-
nications infrastructure, this must be balanced with the invaluable
nature of New York's historic districts.

 AN  ACT to amend the parks, recreation and historic preservation law, in
   relation to directing the state commissioner of parks, recreation  and
   historic  preservation  to create a process to approve or deny certain
   new large urban telecommunication infrastructure
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The  parks,  recreation  and historic preservation law is
 amended by adding a new section 14.13 to read as follows:
   § 14.13 NEW YORK STATE HISTORIC  DISTRICT  TELECOMMUNICATIONS.  1.  AS
 USED  IN  THIS  SECTION,  "LARGE URBAN TELECOMMUNICATION INFRASTRUCTURE"
 MEANS FREE-STANDING STREET OR SIDEWALK PUBLIC TELECOMMUNICATION  INFRAS-
 TRUCTURE GREATER THAN EIGHT FEET IN HEIGHT.
   2.  THE COMMISSIONER SHALL CREATE A PROCESS TO APPROVE OR DENY ANY NEW
 LARGE URBAN TELECOMMUNICATION INFRASTRUCTURE  THAT  IS  PROPOSED  TO  BE
 LOCATED WITHIN TWO HUNDRED FEET OF ANY SITE LISTED ON THE STATE REGISTER
 OR THE NATIONAL REGISTER OR ELIGIBLE TO BE LISTED ON THE NATIONAL REGIS-
 TER; PROVIDED, HOWEVER, THAT SUCH PROCESS SHALL NOT INCLUDE ANY MEASURES
 PREEMPTED  BY  SECTION  106 OF THE NATIONAL HISTORIC PRESERVATION ACT OF
 1966.
   § 2. This act shall take effect immediately.
