BILL NUMBER: S7417 SPONSOR: HOYLMAN-SIGAL TITLE OF BILL: An act to amend the parks, recreation and historic preservation law, in relation to directing the state commissioner of parks, recreation and historic preservation to create a process to approve or deny certain new large urban telecommunication infrastructure PURPOSE: In urban historic districts throughout New York State, new telecommuni- cation structures are being unveiled that are significantly out of char- acter with the neighborhoods in which they are located. This bill would ensure another layer of review for additional placement of new large urban telecommunication infrastructure. HOYLMAN-SIGAL -- read twice and ordered printed, and when printed to be committed to the Committee on Cultural Affairs, Tourism, Parks and Recreation AN ACT to amend the parks, recreation and historic preservation law, in relation to directing the state commissioner of parks, recreation and historic preservation to create a process to approve or deny certain new large urban telecommunication infrastructure THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The parks, recreation and historic preservation law is amended by adding a new section 14.13 to read as follows: § 14.13 NEW YORK STATE HISTORIC DISTRICT TELECOMMUNICATIONS. 1. AS USED IN THIS SECTION, "LARGE URBAN TELECOMMUNICATION INFRASTRUCTURE" MEANS FREE-STANDING STREET OR SIDEWALK PUBLIC TELECOMMUNICATION INFRAS- TRUCTURE GREATER THAN EIGHT FEET IN HEIGHT. 2. THE COMMISSIONER SHALL CREATE A PROCESS TO APPROVE OR DENY ANY NEW LARGE URBAN TELECOMMUNICATION INFRASTRUCTURE THAT IS PROPOSED TO BE LOCATED WITHIN TWO HUNDRED FEET OF ANY SITE LISTED ON THE STATE REGISTER OR THE NATIONAL REGISTER OR ELIGIBLE TO BE LISTED ON THE NATIONAL REGIS- TER; PROVIDED, HOWEVER, THAT SUCH PROCESS SHALL NOT INCLUDE ANY MEASURES PREEMPTED BY SECTION 106 OF THE NATIONAL HISTORIC PRESERVATION ACT OF 1966. § 2.
