BILL NUMBER: S7424 SPONSOR: MAY TITLE OF BILL: An act to amend the state finance law, in relation to funding of state university of New York programs by state agencies PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to increase New York State's indirect cost reimbursement rate for the State University of New York's state spon- sored programs and to minimize contract delays. SUMMARY OF PROVISIONS: Section 1: Makes sure that when SUNY runs a research program for the state, it gets back at least 26% of the program's direct costs to help cover overhead and other necessary expenses that can't be charged directly. MAY -- read twice and ordered printed, and when printed to be committed to the Committee on Procurement and Contracts AN ACT to amend the state finance law, in relation to funding of state university of New York programs by state agencies THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. All New York state sponsored programs conducted by the state university of New York and funded by a New York state agency shall be reimbursed at no less than twenty-six percent of the direct costs necessary to fulfill the obligations of such program's terms related to costs not otherwise allowable as a direct charge. § 2. Section 179-ee of the state finance law is amended by adding a new subdivision 4 to read as follows: 4. NOTWITHSTANDING ANY OTHER PROVISION OF THIS ARTICLE TO THE CONTRA- RY, FOR THE PURPOSES OF A CONTRACT FOR A NEW YORK STATE SPONSORED PROGRAM CONDUCTED BY THE STATE UNIVERSITY OF NEW YORK AND FUNDED BY A STATE AGENCY, A STATE AGENCY MAY AWARD A SOLE SOURCE CONTRACT TO THE RESEARCH FOUNDATION OF THE STATE UNIVERSITY OF NEW YORK, ON BEHALF OF THE STATE OF NEW YORK, WHEN THE STATE AGENCY DETERMINES THAT OPERATION OF SUCH SPONSORED PROGRAM BY THE STATE UNIVERSITY OF NEW YORK WOULD PRODUCE ADMINISTRATIVE EFFICIENCIES OR COST SAVINGS OR PROGRAM RESULTS WHICH WOULD EXCEED THOSE LIKELY TO BE ACHIEVED THROUGH THE USE OF A REQUEST FOR PROPOSALS. § 3. This act shall take effect immediately and shall apply to contracts awarded on or after such effective date.
