TITLE OF BILL:  An act to amend the public health law, in relation to
making technical changes to certain provisions of such law; and to amend
a chapter of the laws of 2024 amending the public health law relating to
requiring that functional epinephrine auto-injector devices be made
available in places of public assembly and that at least one employee or
volunteer of such place of public assembly be trained in its proper
operation and use and be present at each facility function, as proposed
in legislative bills numbers S.  1078-A and A. 2885-A, in relation to
the effectiveness thereof

 
PURPOSE:

This is a chapter amendment that makes changes to provisions of L.2024
C.461, to require epinephrine auto-injector devices be made available in
places of public assembly

 
SUMMARY OF PROVISIONS:

The legislation makes technical changes to the subdivision in Public

Health law where the chapter will be placed.  The legislation also
amends the underlying chapter by extending the effective date from imme-
diately to nine months after enactment.

 
JUSTIFICATION:

This legislation is a negotiated change to the underlying chapter.

 
LEGISLATIVE HISTORY:

Chapter amendment to chapter 461 of the laws of 2024. S.1078A and
A.2885A both passed the Senate and Assembly, respectively, in May 2024.

 
FISCAL IMPLICATIONS:

None

 
EFFECTIVE DATE:
This act shall take effect immediately; provided that sections one and
two of this act shall take effect on the same date and in the same
manner as a chapter of the laws of 2024 amending the public health law
relating to requiring that functioning epinephrine auto-injector devices
be made available in places of public assembly and that at least one
employee or volunteer of such place of public assembly be trained in its
proper operation and use and be present at each facility function, as
proposed in legislative bills numbers S.1078A and A.2885A, takes effect.

 AN  ACT  to amend the public health law, in relation to making technical
   changes to certain provisions of such law; and to amend a  chapter  of
   the  laws of 2024 amending the public health law relating to requiring
   that functional epinephrine auto-injector devices be made available in
   places of public assembly and that at least one employee or  volunteer
   of  such  place  of public assembly be trained in its proper operation
   and use and be present at  each  facility  function,  as  proposed  in
   legislative bills numbers S.  1078-A and A. 2885-A, in relation to the
   effectiveness thereof
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subdivision 5-d of section 225 of the public health law, as
 added by a chapter of the laws of 2024 amending the  public  health  law
 relating  to requiring that functional epinephrine auto-injector devices
 be made available in places of public assembly and  that  at  least  one
 employee or volunteer of such place of public assembly be trained in its
 proper  operation  and  use and be present at each facility function, as
 proposed in legislative bills numbers S. 1078-A and A. 2885-A, is relet-
 tered subdivision 5-e.
   § 2. Paragraph (f) of subdivision 2 of section 3000-c  of  the  public
 health  law,  as  amended  by a chapter of the laws of 2024 amending the
 public health law relating  to  requiring  that  functional  epinephrine
 auto-injector devices be made available in places of public assembly and
 that at least one employee or volunteer of such place of public assembly
 be trained in its proper operation and use and be present at each facil-
 ity  function, as proposed in legislative bills numbers S. 1078-A and A.
 2885-A, is amended to read as follows:
 
  EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                       [ ] is old law to be omitted.

   (f) Nothing in this section shall require any eligible person or enti-
 ty to acquire, possess, store, make available, or administer an epineph-
 rine auto-injector, except  as  provided  for  in  subdivision  [five-d]
 FIVE-E of section two hundred twenty-five of this chapter.
   §  3.  Section  three  of  a  chapter of the laws of 2024 amending the
 public health law relating  to  requiring  that  functional  epinephrine
 auto-injector devices be made available in places of public assembly and
 that at least one employee or volunteer of such place of public assembly
 be trained in its proper operation and use and be present at each facil-
 ity  function, as proposed in legislative bills numbers S. 1078-A and A.
 2885-A, is amended to read as follows:
   § 3. This act shall take effect [immediately]  NINE  MONTHS  AFTER  IT
 SHALL HAVE BECOME A LAW.  EFFECTIVE IMMEDIATELY, THE ADDITION, AMENDMENT
 AND/OR REPEAL OF ANY RULE OR REGULATION NECESSARY FOR THE IMPLEMENTATION
 OF  THIS  ACT  ON  ITS  EFFECTIVE  DATE  ARE  AUTHORIZED  TO BE MADE AND
 COMPLETED ON OR BEFORE SUCH EFFECTIVE DATE.
   § 4. This act shall take effect immediately; provided,  however,  that
 sections  one and two of this act shall take effect on the same date and
 in the same manner as a chapter of the laws of 2024 amending the  public
 health law relating to requiring that functional epinephrine auto-injec-
 tor  devices  be made available in places of public assembly and that at
 least one employee or volunteer of such  place  of  public  assembly  be

 function, as proposed in legislative bills  numbers  S.  1078-A  and  A.
 2885-A, takes effect.
