 AN ACT to amend the correction law, in relation to breast cancer screen-
   ing and diagnostic testing for incarcerated individuals

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 627 of the correction law, as added by a chapter of
 the  laws  of  2024  amending  the  correction law relating to providing
 incarcerated individuals with access to  breast  cancer  screenings  and
 information  about  breast self-examinations, as proposed in legislative
 bills numbers S. 204 and A. 4957, is amended to read as follows:
   § 627. [Routine mammogram  screenings]  BREAST  CANCER  SCREENING  AND
 DIAGNOSTIC TESTING. [Routine mammogram screenings] BREAST CANCER SCREEN-
 ING AND DIAGNOSTIC TESTING shall be offered [every two years] IN ACCORD-
 ANCE  WITH  NATIONALLY  RECOGNIZED  CLINICAL PRACTICE GUIDELINES FOR THE
 DETECTION OF BREAST CANCER UNLESS OTHERWISE RECOMMENDED BY  A  PHYSICIAN
 at no cost to individuals housed in state and local correctional facili-
 ties used for the general confinement of [inmates] INCARCERATED INDIVID-
 UALS  and  in  any  other  state or local facility where individuals are
 detained or confined by law enforcement agencies. FOR  THE  PURPOSES  OF
 THIS SECTION, "NATIONALLY RECOGNIZED CLINICAL PRACTICE GUIDELINES" MEANS
 EVIDENCE-BASED  CLINICAL  PRACTICE  GUIDELINES  INFORMED BY A SYSTEMATIC
 REVIEW OF EVIDENCE AND AN ASSESSMENT OF THE BENEFITS AND RISKS OF ALTER-
 NATIVE CARE OPTIONS INTENDED TO  OPTIMIZE  PATIENT  CARE,  DEVELOPED  BY
 INDEPENDENT  ORGANIZATIONS OR MEDICAL PROFESSIONAL SOCIETIES UTILIZING A
 TRANSPARENT METHODOLOGY AND REPORTING STRUCTURE AND WITH A  CONFLICT-OF-
 INTEREST POLICY.
   §  2.  This  act  shall  take  effect on the same date and in the same
 manner as a chapter of the laws of  2024  amending  the  correction  law
 relating  to  providing  incarcerated  individuals with access to breast
 cancer screenings and information  about  breast  self-examinations,  as
 proposed in legislative bills numbers S. 204 and A. 4957, takes effect.
