BILL NUMBER: S866 SPONSOR: BAILEY TITLE OF BILL: An act to amend the penal law, in relation to re-defining physically helpless PURPOSE OR GENERAL IDEA OF BILL: To amend the penal law in relation to redefining the definition of phys- ical helplessness. SUMMARY OF SPECIFIC PROVISIONS: The bill amends the relevant provision of penal law section 130.00 to define "physically helpless" as someone who is either unconscious or unable to physically unable to communicate affirmative consent. The new bill deletes "unwillingness" from the definition of "physically help- less" and adds "affirmative consent," along with a definition of the new term.

BAILEY, ADDABBO, HELMING, HINCHEY, HOYLMAN-SIGAL, KRUEGER, PARKER, ROLISON, SERRANO, WEBB -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to re-defining physically helpless THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 7 of section 130.00 of the penal law is amended to read as follows: 7. "Physically helpless" means that a person is unconscious or for any other reason is physically unable to communicate [unwillingness] AFFIR- MATIVE CONSENT to an act. SUCH AFFIRMATIVE CONSENT IS A KNOWING, VOLUN- TARY, AND MUTUAL DECISION AMONG ALL PARTICIPANTS TO ENGAGE IN SEXUAL ACTIVITY. CONSENT CAN BE GIVEN BY WORDS OR ACTIONS, AS LONG AS THOSE WORDS OR ACTIONS CREATE CLEAR PERMISSION REGARDING WILLINGNESS TO ENGAGE IN THE SEXUAL ACTIVITY. § 2.
