    Issues to be decided by the court

    Civil Practice Law & Rules (CVP) CHAPTER 8, ARTICLE 42

    Rule 4211. Issues to be decided by the court. The court shall decide
    any issue not required to be tried by a jury unless it is referred to a
    referee to determine pursuant to section 4317.
