§ 27-0900. Applicability.
It is the purpose of this title to regulate the management of
hazardous waste (from its generation, storage, transportation, treatment
and disposal) in this state and to do so in a manner consistent with the
Federal Solid Waste Disposal Act, as amended by public law 94-580, the
Resource Conservation and Recovery Act of 1976, and as further amended
by public law 95-609, the Quiet Communities Act of 1978, public law
96-463, the Used Oil Recycling Act of 1980, public law 96-482, the Solid
Waste Disposal Act Amendments of 1980, public law 98-616, the Hazardous
and Solid Waste Amendments of 1984, public law 99-339, the Safe Drinking
Water Act Amendments of 1986, and public law 99-499, the Superfund
Amendments and Reauthorization Act of 1986, hereinafter referred to as
"RCRA". Nothing in this title shall authorize the department to adopt or
amend any rule or regulation in a manner less stringent than provided in
RCRA.
