§ 29-0507. State licenses, permits, and other approvals exclusive.
Notwithstanding any other provision of law, no county, city, village,
town, or special district, or any agency or instrumentality thereof, may
prohibit, or require any license, permit, other approval, or condition
related to, the construction or operation of low-level radioactive waste
management facilities for which required state licenses, permits, or
other approvals have been issued. Nothing in this section shall preclude
any county, city, village, town, or special district, or any agency or
instrumentality thereof, from requesting, proposing, or advocating
imposition of reasonable conditions on the construction or operation of
low-level radioactive waste management facilities in any proceeding upon
an application for a required state license, permit, or other approval
for such facilities.
