Injunctions
Environmental Conservation (ENV) CHAPTER 43-B, ARTICLE 71, TITLE 19
§ 71-1931. Injunctions.
It shall be the duty of the Attorney General upon the request of the
commissioner to bring an action for an injunction against any person
violating any of the provisions of titles 1 through 11 inclusive and
title 19 of article 17 or violating any rule or regulation promulgated
pursuant thereto, or any order or determination of the commissioner or a
condition of any certificate or permit issued by the department;
provided, however, that the department or the commissioner shall furnish
the Attorney General with such material, evidentiary matter or proof as
may be requested by the Attorney General for the prosecution of such an
action. In any action for an injunction brought pursuant hereto any
finding of the commissioner or hearing officer or panel appointed and
designated by the commissioner shall be prima facie evidence of the fact
or facts found therein.
