Racing, Pari-Mutuel Wagering and Breeding Law (PML) CHAPTER 47-A, ARTICLE 13, TITLE 2-A
§ 1321-k. Zoning. 1. Notwithstanding section thirteen hundred
sixty-six of this article, all gaming facilities licensed pursuant to
this title shall comply with all relevant city, county, town, or village
land use or zoning ordinances, rules, or regulations if applicable.
2. (a) In addition, for any gaming facility located within the city of
New York, all applicable zoning provisions shall be subject to the
uniform land use review procedure pursuant to section one hundred
ninety-seven-c of the New York city charter if such provisions would
otherwise be applicable; and
(b) Any determination on whether gaming is a permissible use or
activity or whether any other activity taken pursuant to the uniform
land use review procedure shall not be subject to a mayoral zoning
override, special permit process, or any other action or decision that
preempts, circumvents, or supersedes the usual and customary local
zoning process.
