Social Services (SOS) CHAPTER 55, ARTICLE 2-A, TITLE 2
§ 45-f. Administration. 1. The commissioner shall promulgate rules and
regulations for the administration of this title. Such rules and
regulations shall include but not be limited to provisions concerning
eligibility of not-for-profit corporations and charitable organizations
for single room occupancy support project assistance, funding criteria
and the funding determination process, supervision and evaluation of the
contracting corporations and organizations and any other matters
consistent with the purposes of this title.
2. The social services district, or the commissioner in the case of
direct applications, shall provide for the review, at periodic
intervals, of the performance of the not-for-profit corporations and
charitable organizations receiving financial assistance pursuant to this
title. Such review shall, among other things, be for the purpose of
ascertaining conformity to contractual provisions, the financial
integrity and efficiency of the organizations and the evaluation of the
project. Contracts entered into pursuant to this title may be terminated
by the social services district, or the commissioner in the case of
direct applications, upon a finding of substantial nonperformance or
other breach by the corporation or organization of its obligations under
its contract.
3. In order to further the purposes of this article, social services
districts shall, in accordance with regulations promulgated by the
department, undertake such efforts as may be necessary and practicable
to assist eligible residents to apply for and obtain appropriate
governmental assistance.
4. The department, subject to the approval of the director of the
budget, may retain up to five percent of the total amount appropriated
pursuant to this title in any fiscal year for administrative purposes.
