Assembly Resolution No. 1079

in relation to the election and seating of Erik
T. Bohen as a Member of the Assembly from the 142nd
Assembly District
WHEREAS, There is a vacancy existing in the membership of this
House, which was filled at a special election held on April 24, 2018;
and
WHEREAS, The final official canvass of the votes cast at said
election and certification thereof of the person elected thereat, cannot
be made at this time; and
WHEREAS, The board of elections of the state of New York has advised
that the votes cast for the Office of Member of Assembly in the 142nd
Assembly District in the county of Erie shown by its canvass were
respectively as follows: Patrick B. Burke, Democratic, Working Families
and Reform, five thousand six hundred fifty-three; and Erik T. Bohen,
Republican, Conservative, and Independence, six thousand sixty; and
WHEREAS, It appears that the results of the votes cast in said
Assembly District cannot be affected by the final official canvass of
such voters; and
WHEREAS, Erik T. Bohen has duly taken an oath of office as a Member
of Assembly; now, therefore, be it
RESOLVED, That Erik T. Bohen, Republican, Conservative, and
Independence, is duly elected and qualified as a Member of the Assembly
for his respective district and that he be seated in this House as such
Member.
