Senator Marcellino Calls On Attorney General To Do His Job

State Senator Carl L. Marcellino (R, Syosset) today called upon the New York State Attorney General to issue a formal opinion regarding New York State’s rights and legal options regarding the siting and operation of the proposed Broadwater Liquefied Natural Gas (LNG) importation facility.

"The time is now to ensure that our rights are heard and that we are part of the decision making process of the siting of liquefied natural gas facilities," restated Senator Marcellino.

This is the second time Senator Marcellino has called upon the Attorney General to issue this opinion in order to ensure that the concerns of New York’s residents are heard on this issue. Currently, Broadwater Energy is arguing that only the Federal Energy Regulatory Commission (FERC) has a say in the siting and operation of the proposed facility.

The following is the text of Senator Marcellino’s second letter to the Attorney General.

On February 17, 2005, I contacted you in order to request a formal opinion on what New York State’s rights are regarding the siting and operation of the proposed Broadwater Liquefied Natural Gas (LNG) importation facility.

On March 2, 2005, your office informed a member of my staff that you would not issue a formal opinion to me regarding our legal options, thus severely limiting New York’s voice in the Broadwater debate.

I am, once again, requesting that you fulfill your duties as the "people’s lawyer" and issue a formal opinion regarding our rights and options. Now is the time to work together in order to protect our State’s residents from the arbitrary whims of Washington, D.C. bureaucrats.
